The Ruler of Travancore as per Article 363 (2) (b) with regards to Art 8 of the covenant governing the administration of Hindu Temples is Shri Padmanabha Swamy Deity acting through His Dasa Shri Padmanabha Dasa

Dr M.V. Soundararajan, Convenor Temples Protection Movement along with his fellow members has made an appeal to PM Narendra Modi with regards to Shri Padmanabha Swamy temple under Article 39A.

He even congratulated the PM for the Dharmic commitment to protect Hindu Deity Rights made on the auspicious day of April 18th 2019 which has been welcomed by one and all.

Recently, It has come to the notice of the members of temples Protection Movement that, “the earlier BJP government had responded to a query on privileges of Prince of Arcot in light of the 26th amendment of the Constitution in Rajya Sabha (enclosed). It is a fact that even today the Government of India is continuing the obligation arising out of the agreement made by the British with the Prince of Arcot through the provisions of The Prince of Arcot Endowments Act of 1922 adapted suitably post-independence.”

Narendra Modi was requested to take the same approach with regards to the obligation arising out of Article 8 of the covenant with Ruler of Travancore Shri Padmanabha Swamy Deity by articulating to the Supreme Court the following as per the mandate of Article 39A

“The superintendence of the Mosques and Tombs in this presidency connected with the Carnatic family will be entrusted to your Highness and to your successors in the title, who will be responsible for the repair and maintenance of these structures receiving such revenues attached to them as are at the disposal of the government subject to a reservation of existing rights”

In the appeal, Narendra Modi was requested to take the same approach with regards to the obligation arising out of Article 8 of the covenant with Ruler of Travancore Shri Padmanabha Swamy Deity by articulating to the Supreme Court the following as per the mandate of Article 39A.

  1. The Ruler of Travancore as per Article 363 (2) (b) with regards to Art 8 of the covenant governing the administration of Hindu Temples is Shri Padmanabha Swamy Deity acting through His Dasa Shri Padmanabha Dasa. The succession to the title of Shri Padmanabha Dasa is governed by the religious customs, usage and traditions of Shri Padmanabha Swamy temple.
  2. The obligation arising out of Article 8 of the covenant protected by Article 363 with regards to the administration of Hindu temples is not impacted by the 26th amendment of the Constitution similar to the agreement with the Prince of Arcot vis-à-vis administration of Mosques and Tombs
  3. Similar to the Prince of Arcot Endowments Act of 1922 the obligation arising out of Article 8 of the covenant is given effect to by the Travancore Cochin Hindu Religious Institutions Act.

Since Shri Padmanabha Swamy temple case is already reserved for judgement in Supreme Court they want this appeal to be acted upon with due urgency.

  1. on thinking further, it now appears that Modi sought votes in 2014 on development plank, and not on Hindutva plank, because he had no intention to do anything to Hindus. BJP grew as a Hindutva party, used Hindus as vote bank and finally ditched them. Muslims benefited from banning of triple talaq. Hindus gained nothing from BJP rule.

  2. yaMIt appears that Modi is useful only to the extent of keeping away Congress, UPA and Mahaghatbandhan, who are less desirable than BJP. Perhaps he was useful to the poor in construction of toilets. Perhaps he was useful to those who got Mudra loans. He is only slightly better than other politicians. And, he is good in giving lengthy speeches, longer than one hour, like the one he gave on the evening of May 25, 2019, in the central hall of Parliament.

  3. On May 25, 2019, after being elected as leader of BJP and NDA parliamentary party in the central hall of parliament, Modi addressed all NDA MP’s for more than an hour. He said minorities were cheated for 70 years and we must stop this deception. He said minorities were used as vote bank. But, what about Hindus? Were Hindus not cheated for 70 years or even more? Are Hindus not being used as vote bank by the so-called Hindutva party? Should we not stop this deception? The Hindus do not even have freedom of religion. Their freedom of religion is curtailed by government control of Hindu temples and charities.

  4. I urge TEAM PGURUS to write a comprehensive article on the politics, conspiracy etc behind government control of Hindu temples and charities. Why the so-called Hindutva party is doing nothing about it, not even in states ruled by BJP?

  5. Is it secular or communal for a government to manage Hindu temples? Is it controversial to release Hindu temples from government control? Intervention of a government in religious affairs is against SECULARISM. Few centuries ago, the church used to interfere in governance in western countries. So, in the west, this concept of SECULARISM originated, which meant non-interference of church in matters of governance. But now, in India, the governments are interfering in matters of religion. Is this SECULARISM or COMMUNALISM? Is this a conspiracy to suppress Hindu religion and encourage conversions to other religions? Why is the so-called Hindutva party doing nothing about it? At least the BJP-ruled state could have set an example by releasing Hindu temples from government control.

  6. SAB KAA SAATH, SAB KAA VIKAS, SAB KAA VISHWAAS. Today, May 25, 2019, after getting elected as leader of the BJP parliamentary party and also as leader of all MP ‘s of NDA, Modi spoke about winning the trust of minorities. But, what about winning the trust of Hindus? Hindu culture is in ruins now. Releasing Hindu temples from government control is the bare minimum that needs to be done immediately.

  7. I also tweeted to our Prime Minister, Narendra Modi, requesting him to releaseHindu temples from government control. There was no response. He may be receiving millions of tweets everyday from millions of his followers.

  8. HRCE stands for Hindu Religious and Charitable Endowments. I do not know the situation in North India, but I think all South Indian states have endowments departments controlling Hindu religious and charity institutions. Are Hindus incapable of managing their own religious and charitable entities? Why doesn’t the government control the non-Hindu institutions? It is surprising that in India the minorities enjoy freedom, but the majority community has no freedom to manage its religious and charitable entities? Is this not violation of my FREEDOM OF RELIGION? When I am not allowed to manage my temples and charities, when government takes over my temples and charities, my FREEDOM OF RELIGION is violated.

  9. Ram Sethu is not declared as national monument till now. Dr Subramanian Swamy tweeted that the file is pending on Modi’s table since a long time now. No hope of Modi doing the needful. We all foolishly thought that justice would be done to Hindu issues if BJP comes to power.

  10. Modi was in power for five years from 2014 to 2019. But Hindu temples remain under government control. He won again now on May 23, 2019. Can we expect him to release all Hindu temples from government control? I am surprised that nobody talks about it in Parliament or TV channels. It was never an election issue. What is the use of BJP coming to power?

  11. I also tweeted several times to Dr Subramanian Swamy, asking him about freedom to Hindu temples and the “superseding legislation” preventing state governments from taking over Hindu temples. But there was no response.

  12. I remember, soon after Modi won in 2014, there was a meeting in Bangalore about freedom to Hindu temples. Pujya Swami Dayananda Saraswathi spoke about how Hindu temples suffered under government control. In that meeting, Dr Subramanian Swamy said a “superseding legislation” can be passed by the Parliament preventing state governments from taking over Hindu temples. But nothing happened till now. Pujya Swamiji also met the PM, Narendra Modi, at New Delhi. I saw photos published in newspapers. He would have surely raised this issue with PM. Nothing happened till now.
