BJP government has continued discrimination against Hindus

Why should Hindus be subjected to perpetual discrimination and disparity? Why should Hindus be denied parity and equality?

Though Article 15(1) of the Indian Constitution prohibits discrimination against any Indian citizen on the ground of religion, and though the Preamble of Indian Constitution guarantees to all Indian citizens “Justice”, “Liberty”, “Equality”, and “Fraternity”, as discussed in this write-up, Indian governments appease minorities (i.e. non-Hindus), and discriminate against Hindus on the basis of religion.

To escape discrimination, some Hindu sects proclaim that they are not Hindu.

Such blatant state-sponsored discrimination does not exist in any other country in the world.

After getting power in 2014 on nationalist agenda, BJP has done nothing to fulfil its crucial promises regarding justice to all and appeasement of none, uniform civil code, Article 370, rehabilitation of Kashmiri Hindus in Kashmir etc. etc. On the contrary, the BJP government has continued and expanded the Congress-led government’s anti-Hindu, discriminatory, pseudo-secular and minority-appeasing laws and policies.

BJP government has continued the division of the nation into majority and minority; and has not repealed or amended any existing law to stop discrimination against Hindus and to treat Hindus at par with other communities.

And to escape discrimination, some Hindu sects proclaim that they are not Hindu. While earlier, Ramakrishna Mission had claimed itself to be a non-Hindu minority, now some Lingayats in Karnataka want the non-Hindu tag.

This discrimination against Hindus is destroying Hindu civilization.

Some of the discriminatory policies are described briefly as follows:

i. Incentives and schemes only for minorities

As the opposition party, BJP had condemned the Congress-led government’s creation of Sachar Committee and Ministry of Minority Affairs in 2006 as communal, divisive and “appeasement” of minorities.

Though it requires just a Cabinet decision (and it does not require any law) to abolish the Ministry of Minority Affairs and its communal policies, the BJP government has not taken any such action so far.

Instead, as described below, it has continued and expanded minority appeasement policies as ‘minority empowerment’ policies and is allocating thousands of crores of rupees every year for the same.

Apart from having schemes like “Nai Manzil” (training Madrassa students for government jobs), “Shadi Shagun” (Rs.51,000/- paid on the marriage of minority women), minority students are given pre-matric and post-matric scholarships and fellowships as financial assistance for M.Phil. and PhD courses.

Padho Pardesh” scheme offers interest-free bank loans of up to rupees twenty lakhs to a minority student for pursuing Post-Graduate Diploma, Masters, M. Phil or PhD course in a foreign university. And interest on such loans is paid by the government as subsidy.

The scheme “Naya Savera” provides free special coaching etc. to minority candidates/students for admission for technical and professional courses and for recruitment to government and public sector jobs.

Every minority student gets a scholarship of rupees one lakh for Civil Services Examination, and up to rupees one lakh per academic year for preparation of Medical/Engineering entrance examinations.

Under “Nai Udaan”, minority students get financial support for preparation of Main Examination conducted by Union Public Service Commission, Staff Selection Commission and State Public Service Commissions.

And naming it as Pradhan Mantri Jan Vikas Karyakram, B.J.P. Government has expanded Multi-sectoral Development Plan for Minorities to 308 districts.

ii. Right to Education Act, 2009

The Congress-led government brought “Right of Children to Free and Compulsory Education Act, 2009” which provides for government’s ruthless control only over Hindu-run schools since Minority-run schools are exempted from this Act.

This Act requires Hindu-run schools to provide free education (with negligible compensation from the government) to at least 25 per cent students from weaker sections and also stipulates many stiff conditions for Hindu-run schools.

This Act has made the cost of running schools by Hindus prohibitive thereby closing thousands of Hindu-run schools all over the country. On February 24, 2016, National Independent Schools Alliance protested in New Delhi against this Act and appealed for its repeal or suitable amendment.

Despite the havoc caused by this Act to Hindu-run schools, BJP government has not repealed or amended it so that all schools, whether run by the majority or by minority community, are either covered by this Act or are free from this Act.

Though proclaimed as a secular country, India has no uniform civil code though it has the uniform criminal code.

iii. Government’s control of Hindu temples

Though Hindu temples are the symbols of Hindu identity and centres of Hindu civilization, all prominent Hindu temples all over India, and having assets worth thousands of crores of rupees, are under the government’s control. But no mosque or church is controlled by the government.

Government’s control of Hindu temples and their estates is depriving Hindus of their right to religious freedom guaranteed under Articles 25 and 26 of Indian Constitution and is also depriving Hindus of the self-supporting infrastructure of their places of worship.

B.J.P. government has taken no action to liberate Hindu temples from government control so that like other communities, Hindus too can enjoy their fundamental right to religious freedom.

iv. Cultural and Educational Rights

Articles 29 and 30 of Indian Constitution deal with cultural and educational rights of Minorities.

Article 30 entitles minorities to establish educational institutions of their choice.

Though these Articles were meant to ensure equality between the majority and minority communities, in actual practice, Hindus have been deprived of the freedom to run their educational institutions while minorities are given full freedom in this regard.

Pioneers of Ramakrishna Mission like Swami Vivekanand were glorious Hindus. But to save its educational institutions from government’s takeover, Ramakrishna Mission unsuccessfully claimed before the Supreme Court that it was a (non-Hindu) religious minority covered by Article 30.

BJP government has not initiated any action to amend Articles 29 and 30 to extend the rights stipulated therein to every community, whether majority or minority.

v. Articles 370 and 35A

Article 370, and its off-shoot Article 35A (inserted by a Presidential Order under Article 370 in 1954) have all along encouraged separatism and terrorism and are responsible for genocide and eviction of Hindus from Kashmir.

During the 1980s and 1990, Pakistan-sponsored terrorists killed several Hindus in Kashmir forcing lakhs of Hindus to flee from Kashmir. Driven out from their ancestral homes, Kashmiri Hindus are leading a miserable life in cramped camps in Jammu, Delhi and other places.

B.J.P.’s Election Manifesto had promised abrogation of Article 370 and return of Kashmiri Hindus “to the land of their ancestors with full dignity”. However, so far BJP government has taken no such action. And Kashmiri Hindus are still waiting for their rehabilitation in Kashmir.

Instead of taking action for deleting these Articles, BJP government has been seeking the adjournment of hearing for filing its reply on petitions for repeal of Article 35A filed in 2014 by “We the Citizens”, and by others before the Supreme Court.

vi. “Uniform Civil Code” is discarded

One policy which can ensure the same rights for all Indian citizens irrespective of their religion is the implementation of the uniform civil code.

In any really “secular country”, all citizens irrespective of their religion are given the same rights and are governed by same laws. But though proclaimed as a secular country, India has no uniform civil code though it has the uniform criminal code.

B.J.P.’s Election Manifesto had promised implementation of Uniform Civil Code. Besides, Uniform civil code will make India a real secular country. Moreover, Supreme Court has suggested its enactment in a number of judgements. And Article 44 of Indian Constitution stipulates that “The State shall endeavour to secure for the citizens a uniform civil code throughout the territory of India”. Still, the BJP-led government has done nothing in this regard.

The result is the above-mentioned discrimination being faced by Hindus.

The ideal solution of this hapless situation is that the nationalists must reject both Congress Party and BJP.

Way out

At present, Hindu civilization is facing the worst-ever challenge to its survival in history.

But the problems being faced by Hindus and Hindu civilization are political problems which can be solved only politically since only the state power and government can undo the above-described discrimination.

However, at present, there is no political party which wants to stop discrimination against Hindus and treat them at par with other communities.

The ideal solution of this hapless situation is that the nationalists must reject both Congress Party and BJP, and form a new and strong nationalist political party which would liberate the country from slavery of pseudo-secularism, ensure same rights and same laws for every Indian citizen irrespective of his religion, and would not discriminate against any citizen, whether belonging to majority or to minority community.

However, till such a political party materializes, nationalists must assert themselves and launch a strong, peaceful, constitutional and lawful movement to request the government to stop the above-mentioned flagrant discrimination against Hindus and to give the same rights and same laws for every Indian citizen irrespective of his religion.

And this outrageous discrimination must be stopped if Hindu religion and Hindu civilization are to survive.

  • It is nice article and eye opening however, I think PM Modi's main agenda is to make Nation first free from corruption. When people from lower strata are uplifted and made to ignore Anti-nation agendas of some parties.I hope to get better performance on the issues raised by the respected Arora ji in future!

  • I agree with the learned writer but beg to differ in solution. At this juncture we should support the BJP and if it is elected in 2019. then exert pressure to exert it to follow pro-Hindu policies. We must see that the Congress is defeated at any cost as it is both corrupt and anti-Hindu party,.

  • After getting power in 2014, BJP has forgotten who had voted for it and why. As rightly explained in this article, BJP government has forgotten its promises including those regarding Uniform Civil Code, Article 370, rehabilitation of Kashmiri Hindus in Kashmir etc. etc. But on the contrary, it has continued and expanded the discriminatory and minority-appeasing laws and policies of the former Congress-led governments.

  • It is shocking that after getting power on the nationalist agenda as evident from its Election Manifesto of 2014, BJP has continued and expanded the Congress-led government’s minority-appeasing and anti-Hindu laws and policies. As highlighted in this article, as an opposition party, BJP used to condemn Congress-led government’s said policies as divisive and discriminatory.
