In the mysterious death of Sunanda Pushkar, Delhi Police on Saturday unleashed the truth before the Fast Track Court by asking for adding up murder charges against her husband and Congress Member of Parliament (MP) Shashi Tharoor. “Please frame sections 498-A (husband or his relative subjecting a woman to cruelty), 306 (abetment of suicide) or in alternative 302 (murder) IPC against the accused (Tharoor),” the probe agency told special judge Ajay Kumar Kuhar.
Senior public prosecutor Atul Srivastava made the submissions during arguments on the framing of charges in the case.
The Delhi Police Prosecutor reiterated that as per the medical records and opinion, the cause of death is poisoning. There are blunt force injuries, which are simple in nature, and produced in a scuffle. The injury marks are for the duration of 12 hours to four days. The Prosecutor presented the scenario that poisoning could be injected or oral. However, there can be three instances of poisoning that either it be self-consumed, forcibly given either orally or injected, said Prosecutor Srivastava, reiterating murder charges (IPC 302).

Srivastava also read Sunanda’s brother’s statement that Sunanda was happily married and was a strong lady. We could have never thought that she would take such an extreme step like suicide. He also presented domestic helper Narayan and Journalist Nalini Singh’s statements exposing the frequent fights between Sunanda and Shashi Tharoor over many issues including his relations with Pakistani journalist Mehr Tarar and another girl called ‘Katy’.
The Prosecutor also told the court that Tharoor had lived with Mehr Tarar for three days in Dubai and Sunanda came to know about this immoral relationship, leading to physical fights.
The Prosecutor said that before her death, Pushkar wanted to address a press conference on the Indian Premier League (IPL) issue and had said “I will not leave him (Tharoor)”. In the early morning (on January 17, 2014, the day she was found dead at Hotel Leela) Sunanda contacted journalists Barkha Dutt, Sagarika Ghose, Rahul Kanwal and Prema Sridevi about her plan to talk to media about the murky tales of IPL Cricket and to expose her cheater-husband, Shashi Tharoor.
Police told the court that Pushkar was suffering from mental agony due to a strained relationship with her husband. She had a scuffle with her husband and had various injury marks a few days before her death, they said. The probe agency told the court that according to the post-mortem report, the cause of Pushkar’s death was poisoning and 15 injury marks were found on various parts of her body, including in forearm, arms and legs.
Senior advocate Vikas Pahwa, appearing for Tharoor, refuted the submissions, saying the arguments made by the prosecutor were contrary to the bare reading of the charge sheet and the charges pressed by him were “absurd and preposterous”. The case is now listed for the next hearing on October 17.
The maximum punishment for the offenses listed in the charge sheet is 10 years of imprisonment. However, if convicted for 302 (murder), the maximum punishment is the death penalty while the minimum is life imprisonment.

BJP leader Subramanian Swamy’s petition to Delhi High Court forced Delhi Police to act. However, Justice Muralidhar of Delhi High Court dismissed Swamy’s petition. Swamy approached Supreme Court and Justice Arun Mishra issued a notice to Delhi Police and before relying on Supreme Court, Delhi Police filed a charge sheet against Tharoor to save its face.
