As the opposition party, BJP (Bharatiya Janata Party) used to proclaim “justice for all and appeasement of none” as its fundamental principle; and used to condemn Congress (Indian National Congress) party’s discriminatory laws and minority-appeasing policies. Besides, BJP had promised to implement “Uniform Civil Code” in its Election Manifestoes of 2009, 2014 and 2019. But after getting power in 2014, the BJP government has forgotten about “justice for all and appeasement of none” and “Uniform Civil Code”.

Moreover, instead of dismantling the Congress-led governments’ pseudo-secular apparatus, BJP government has continued and expanded the Congress-led governments’ discriminatory, pseudo-secular and minority-appeasing laws and policies which are destroying Hindu civilization, one of the oldest surviving civilizations of the world. And immediately after winning the 2019 elections, BJP government declared five crore scholarships for minorities on June 5, 2019.

Logically in 1947, on India’s partition on a religious basis, creation of Pakistan truncated India should have been declared a Hindu republic. Instead, the hoax of “pseudo-secularism” was foisted on India.

This write-up describes how despite Constitutional mandate of “justice” and “equality”, and despite Article 15(1) of Constitution prohibiting discrimination on grounds of religion, pseudo-secular policies have divided the nation into majority and minority. It describes various laws and policies favouring minorities and discriminating against the majority. It also gives the do-able and easy solution for ending this discrimination. This discrimination acts as an invitation to vulnerable sections of Hindu society to convert to a minority religion if they want to avail of benefits being given to minorities.

Besides, it is fragmenting Hindu society since to escape discrimination, some Hindu sects proclaim that they are not Hindu. While earlier, Ramakrishna Mission had claimed itself to be a minority, now many Lingayats in Karnataka want minority tag.

Nation divided into majority and minority

Logically in 1947, on India’s partition on a religious basis, creation of Pakistan truncated India should have been declared a Hindu republic. Instead, the hoax of “pseudo-secularism” was foisted on India.

Though the term “secularism” implies separation of state and religion; “equality before law”, same rights and same laws for every citizen; and non-discrimination on grounds of religion, anything which is discriminatory and pro-minority is “secularism” in India.

Though Indian Constitution does not define the terms ‘majority’ and ‘minority’, vide the Congress government’s “National Commission for Minorities Act, 1992”, the nation got divided into ‘majority’ and ‘minority’ on a religious basis. As per this Act, Muslims, Christians, Sikhs, Buddhists, Zoroastrians were notified as minority communities in October 1993, and Jains in January 2014.

Chapters 6 entitled “Equitable and Inclusive Education: Learning for All” and Chapter 14 entitled “Equity and Inclusion in Higher Education” are the more important parts of this policy.

Some discriminatory policies are described as follows:

1. Special privileges for minorities

While BJP was in opposition, it had labelled the Congress-led government’s creation of Sachar Committee and Ministry of Minority Affairs in 2006 as communal, divisive and “appeasement” of minorities.

But after getting power in 2014, instead of abolishing the Ministry of Minority Affairs, the BJP government has continued this Ministry and has vastly expanded minority-appeasement policies. It has launched many new schemes including those named as “Nai Manzil”, “Nai Udaan”, “Naya Savera”, “Shaadi Shagun”, “Padho Pardesh” etc. etc. for minorities.

Under these schemes, the government is giving various financial and educational incentives, pre-matric and post-matric scholarships, free-ships, free special coaching etc; to minority students/candidates for admission for professional courses and for recruitment for government jobs, financial incentives for higher studies in foreign universities; etc. etc.

BJP government is allocating thousands of crores of rupees for these schemes for minorities every year.

Besides, renaming it as Pradhan Mantri Jan Vikas Karyakram, BJP Government has expanded Congress-led government’s Multi-sectoral Development Plan for Minorities to 308 districts.

2. New Education Policy, 2020

BJP government’s New Education Policy (NEP), 2020 further expands minority-appeasement in the field of education. NEP, 2020 is a very lengthy document. Many persons are praising this policy without having read it.

Chapters 6 entitled “Equitable and Inclusive Education: Learning for All” and Chapter 14 entitled “Equity and Inclusion in Higher Education” are the more important parts of this policy.

Chapter 6 has created a special category named as Socio-Economically Disadvantaged Groups (SDEGs), and has included minorities in these groups. Since the earlier educational system was having special provisions for SC, ST, OBCs, and females. NEP, 2020 include minorities also for special treatment as part of “SEDGs”. Chapter 6 also stipulates that “regions of the country with large populations from educationally-disadvantaged SEDGs should be declared Special Education Zones (SEZs)”.

Like for school education, Chapter 14 dealing with higher education also contains many special privileges for college education which SEDGs including minorities have been given. These include, inter alia, special funds, special scholarships, creation of separate colleges and universities, relaxation of norms for admissions etc. etc.

Government has done nothing to amend Articles 29 and 30 to extend the rights stipulated therein to every community, whether majority or minority.

3. Right to Free Education Act, 2009

The Congress-led government brought “Right of Children to Free and Compulsory Education Act, 2009” providing for government’s stringent control only over Hindu-run schools since Minority-run schools are exempted from this Act.

This Act stipulates many stiff conditions for Hindu-run schools apart from requiring these schools to provide free education (with negligible compensation from the government) to at least 25% of students from weaker sections.

This Act has made the cost of Hindu-run schools prohibitive resulting in the closure of thousands of Hindu-run schools. In February 2016, National Independent Schools Alliance protested in New Delhi against this Act and appealed for its repeal or suitable amendment.

Despite the damage caused by this Act to Hindu-run schools, the BJP government has neither repealed nor amended this Act for giving uniform treatment to all schools, whether run by majority or by the minority community.

4. Cultural and Educational Rights

Articles 29 and 30 of the Indian Constitution deal with cultural and educational rights of Minorities.

Article 30 entitles minorities to establish educational institutions of their choice.

Though these Articles were meant to ensure equality between the majority and minority communities, in actual practice, Hindus have been deprived of the freedom to run their educational institutions while minorities get full freedom in this regard.

Government has done nothing to amend Articles 29 and 30 to extend the rights stipulated therein to every community, whether majority or minority.

5. Control of Hindu places of worship

All prominent Hindu temples all over India, and having assets worth thousands of crores of rupees, are under government’s control. But minority places of worship enjoy freedom from government control.

The government’s control of Hindu temples and their estates is depriving Hindus of their right to religious freedom guaranteed under Articles 25 and 26 of the Indian Constitution and is also depriving Hindus of the self-supporting infrastructure of their places of worship. Government has taken no action to liberate Hindu temples from government control to treat Hindus at par with other communities in religious matters.

6. “Uniform Civil Code-pledge” is not honoured

The single policy which can undo discriminatory laws and policies is the Uniform Civil Code. But though proclaimed as a secular country, India has no uniform Civil Code despite having Uniform Criminal Code.

Though Uniform Civil Code will make India a really secular country, though Supreme Court has suggested its enactment in a number of its judgements; though Article 44 of Indian Constitution stipulates that, “The State shall endeavour to secure for the citizens a Uniform Civil Code throughout the territory of India”, and though BJP had promised its implementation in its Election Manifestoes of 2009, 2014 and 2019, BJP government has not honoured its said pledge so far with the result that discriminatory laws and policies are continuing.

7. Bill for equal rights not passed

In 2016, Dr Satya Pal Singh, BJP member of Lok Sabha had introduced Bill number 226 seeking amendment of Articles 15, and Articles 25 to 30 to extend the religious, educational and cultural rights stipulated therein to every community, whether majority or minority. This Bill wanted to treat Hindus at par with other communities.

Shockingly, despite its majority in Lok Sabha, the BJP government did not pass this Bill. And the Bill lapsed with the result that discrimination against Hindus in religious, educational and cultural matters is continuing.

The only solution

As aptly put by Eleanor Roosevelt, “No one can make you feel inferior without your permission.”

The above-mentioned disgraceful discrimination will continue until the victims of discrimination stand up against it.

Let us see the record of two major political parties.

Congress Party has been minority-centric in its approach. And ever since getting power in 2014, BJP government has continued Congress-led governments’ discriminatory laws and vastly expanded minority-appeasing policies.

Considering this hapless situation, nationalists must reject both Congress and BJP, and form a new and strong political party which would liberate the country from the slavery of pseudo-secularism and ensure same rights and same laws for every Indian citizen irrespective of his religion.

However, till such a political party materializes, nationalists must come out of their comfort zone and conceptual confusion and do their utmost to launch a strong, peaceful, lawful and sustained movement to request the government to take the following actions at the earliest:

  • BJP government must abolish the Ministry of Minority Affairs, and help all deserving Indian citizens irrespective of their religion. And it requires just a Cabinet decision to do so.
  • As BJP had promised to implement Uniform Civil Code in its Election Manifestoes of 2009, 2014 and 2019, BJP government must honour the said pledge and implement it.

Both the above actions are easily do-able. And both these actions are indispensable for the survival of Hindu civilization and for transforming India into a just, fair, strong, harmonious, and united nation.

  1. I have read this whole article. It is a great TRUTH and the TRUTH must prevail. Basically:
    1. There ought not to have any political parties. Citizens ought to be elected purely on the basis of their character, patriotic feelings, selfless service to the nation by serving citizens. That includes morals, ethics, Yam, Niyam, etc.
    2. रघुपति रीत सदा चली आई, प्राण जाय पर वचन न जाई । If BJP promised and not delivered good on it, then they are also kind of dead. But we chose the best out of worst.
    3. When the country was divided on the basis of religion, then why are there muslims, Christian’s. Etc are in the nation?
    3. WHY is the Constitution not followed in it’s TRUE spirit? When Constitution doesn’t mention about minority and majority then why are ministries made for minorities?
    4. IN ONE COUNTRY, THERE OUGHT TO BE ONE LAW FOR ALL CITIZENS OF THAT COUNTRY IRRESPECTIVE OF THE RELIGIONS, POVERTY, ETC. ETC. Why are temples regulated by the government whereas the mosques, churches, etc are not. Same way why are madrassas and convent schools not regulated by the same education policy as gurukuls and Hindu schools?

    India is divided in languages, religions, provinces, castes, poor and rich, etc. etc.
    The list is long. Unless we have a constitution like “The Alternate Constitution of Bharat, i.e, India ” by Bharat Somal, the India shall continue to be exploited by the rest of the world. For detail of exploitation please read “India on Sale, Part 1 and Part 2” by Bharat Somal.

    Our leaders have deaf ears to properly educate our citizens. Our leaders may that be Dr. Manmohan Singh ji on Ganga cleanup when he was PM, OR Modi ji on Education do not reply their citizen’s communications to them inspite of having a scores of staff to answer and act under them. And they are paid by citizen’s taxes, etc. That is not the Indian culture, or human nature. नमस्ते का उत्तर नमस्ते ही होता है। कोई पत्र लिखे तो पत्र का उत्तर पत्र से या फोन से देना आवश्यक हो जाता है । Whereas in the USA you wrote to Obama when he was president or to any senator or congressman you get the reply within 2-3 weeks.

  2. The article is very informative. The new NEP will Institutionalize the discrimination by way of a policy document is real sad news. Who decided the composition of NEP committee members? What were the available names, what was the criteria to chose the members is a very serious matter and can/should be challenged in some court of law.

    Can a professor of Princeton University decide what we need in national education policy or a ex ISRO person be chairman of such a committee can be part of the issues framed before the court where this matter be tried.

  3. Bharat as Nation with Sanatan Identity has survived for over 10,000 years. We have also survived over 1300 years of foreign invasions. We fought, we won, we flourished as a Civilization. But in last 73 years of post independence period, our civilisation has been bleeding by thousands cuts by internal & external enemies and not only by apathy of ruling class but also by active collision of power hungry selfish short-sighted politicians. If policies of appeasement goes unchecked for another few years, Nation will be suffering irreparable loss. The self destructive policies are destroying India at a faster pace. Nation is getting weakened. Responsible persons are either active collaborators or meek spectators. I wonder why the educated and enlightened patriots are silent. The silence is deafening. It’s time for people to Awake, Arise and Act before it’s too late. Due to these discriminatory policies , the damage done to Sanatan Dharma is irreversible. I salute Respected JG Arora Sahab for honest analysis of the pathetic situation and has courage to write wich an eye opening article.   5. Arora’s article is excellent, but, unfortunately, I am afraid, Hindu masses may not be aware of the content. Most of Hindus are too much tolerant, timid and insensitive to injustice to Hindu society, and so it is not easy to awaken them in a few days. Consequently, we should not be in hurry to demolish the present BJP government, which has already done many good things like abrogation of Articles 370 and 35 -A of the Constitution, the CAA etc. The danger is, that Hindus, who are already not united like Muslims, may be further divided and weakened to the advantage of the greatest foe of the BJP and the Hindu civilization, the Islamic Congress backed by the Leftists and the ISI of Pakistan. This had happened in 2004 which resulted in the arrest of Shankaracharya, Lt.Col. Purohit, Sadhvi Pragya Singh etc.Hindus on false charges and many terrorist attacks by Pakistani terrorists with the support of local Muslim accomplices.
    This means that without adversely affecting the present Hindu unity and the BJP, we must awaken Hindu masses in crores and make them write to the Hon’ ble P.M. to accept the rightful demands and do justice to Hindus, who are the backbone of this government.

  8. The issues raised by Shri. J. G. Arora saheb are fully justifiable. The constitutional right in opening educational institutions by the minority community in our country has played havoc. From the childhood years itself, these educational institutions imparting education in Urdu and Arabic medium to the target community, pour venom of separatism and fundamentalist attitude. In the 50s and 60s when such educational institutions were not in big numbers in all the part of the country, the children from minority community used to study in the same school or college where majority community students used to study and there used to be lot of bonhomie. This is my personal experience. However, things have changed now with Madarsa type education being imparted to minority students in the schools and colleges set by the minority community. Neither there is intermixing with majority community students nor are they taught on secular lines. It has resulted in creating water tight compartment between the majority and minority community and the worst part is feeding the children of separatist tendencies from their early age. Hence I fully support Shri J G Arora saheb, on all the issues he has raised. Uniform Civil Code, Abolition of Minority status and befits with suitable amendment to the Constitution of India are the prime needs at this juncture.

  12. This article is just excellent. It brings to fore the discriminatory provisions of law in our country. These policies are clearly in violation of Fundamental Right of Equality enshrined in Article 14 of the Constitution of India. They are against the provisions of Article 15(1) of the Constitution also. No government is willing to end or amend them due to policy of vote bank appeasement. We must unite and make effort to get these discriminatory provisions in various laws repealed. Though it appears quite difficult yet we have to raise our voice against this discrimination.

People are forgetting their religion, their culture and their civilization. The country is stuck in minorityism and majoritarianism. The future of Hindu civilisation looks bleak.       And they don’t have to destroy anything. Just like they eliminate paganism but kept the festivities and things like Kaaba and Easter, they will do the same if allowed.

And as per the dictates of real secularism, discriminatory laws and divisive policies must be replaced by same laws and same rights for all Indian citizens irrespective of their religion.

  27. Thank You. I served in the Indian Army and I never had the opportunity to participate in partisan politics. I would not view this issue in terms of political performance of either the Congress or the BJP.
    As a nationalist, I view this issue as the perpetuation of the British policy of Divide and Rule. India achieved its political independence in 1947 strictly on the terms dictated by the Imperialistic power that ruled over India’s destiny.
    To some extent, I may rationalize the motives of the British Empire to perpetuate its power by wilful subjugation, repression, suppression, and domination of the people of the British Colony. After attaining full independence, there is no excuse for any political party of India to use the British Policy to keep itself in power.
    I would openly ask the Indian Prime Minister to take the challenge and give the people their true freedom. We cannot be free while we actually live and work as slaves. The Bharatiya Janata Party must take the risk of losing its political power and take steps to end the policies of discrimination based upon religion, language, region, caste, and ethnicity. We must truly aspire to be free and equal people united by one law, the supreme law of the Land.

  28. Discriminatory laws and policies on the basis of religion of various citizens would damage the social fabric of any country. By giving same rights and and same laws to every Indian citizen irrespective of his religion is the first requirement of any secular country. And as per its Constitution, India is declared as a secular country.
    Early implementation of Uniform Civil Code as promised in BJP’s Election Manifestoes of 2009, 2014 and 2019 would be in the best interest of the nation.

  32. This is an excellent article.
    The author has nicely clarified all the facts and has given a just, fair, equitable and do-able solution. It is shocking that BJP government has continued the Congress-led governments’ discriminatory laws and policies which are damaging Hindu civilization. It must be ensured that all Indian citizens are governed by the same laws; and enjoy the same and equal rights. That would be real secularism.
