Collapsing the dreams of Congress President Rahul Gandhi, Union Home Ministry on Tuesday issued a notice to him seeking reply in two weeks, to explain the secret British Citizenship. The Home Ministry was issuing a notice to Rahul Gandhi on the complaint filed by BJP leader Subramanian Swamy on September 21, 2017, urging to cancel Rahul’s Indian citizenship and Parliament Membership. Home Ministry’s Notice has put Rahul Gandhi’s political life in danger and it is near impossible for Rahul to reply as Swamy’s has produced Rahul’s self-declaration as being a Briton.
“I am directed to say that this Ministry has received a representation from Dr. Subramanian Swamy, Hon’ble MP in which it has been brought out that a Company named Backops Limited was registered in the United Kingdom in the year 2003, with address 51 Southgate Street, Winchester, Hampshire SO23 9EH and that you were one of the Directors an Secretary of the said Company. It has been further brought out in the complaint that in the Company’s Annual Returns filed on 10/10/2005 and 31/10/2016, your date of birth has been given as 19/06/1970 and that you had declared your nationality as British,” said the Home Ministry’s notice dated April 29, 2019 to Rahul Gandhi seeking reply in “fortnight”.
In his complaint to Home Ministry Swamy produced documents of Rahul’s company showing on many occasions declaring himself as a British citizen with two London addresses. “Finally in the dissolution application in 2009 as well, Mr. Rahul Gandhi states that his nationality is British as on the date he was appointed as Director of the said company,” said Swamy.
“This is, prima facie, a violation of the law and the Constitutional position in the country as stated below:
As per Article 9 of the Indian Constitution, every citizen of India is barred from voluntarily acquiring citizenship of any foreign State. While the United Kingdom permits Dual Citizenship, India emphatically does not. Article 18 prohibits an Indian citizen from accepting even foreign titles. Hence Mr. Rahul Gandhi has, prima facie, committed an unconstitutional act and therefore liable to be stripped of his citizenship and membership of the Lok Sabha.
No Member of Parliament can incorporate a company abroad without prior permission under the existing laws and without declaring the same in his nomination form as a candidate for election to Parliament.
Hence In urge you to treat this matter with great urgency and immediately take necessary steps to see if this prima facie evidence is rebuttable, and if not, order that Mr. Rahul Gandhi is stripped of his citizenship, and his membership of the Lok Sabha, forthwith,” said Swamy.
Later Swamy produced Rahul Gandhi’s secret bank account in the name of Raul Vinci in London and accused Rahul Gandhi of holding illegally two Indian passports and British and Italian Passports[1].
The BJP leader in November 2015 had brought this issue before Lok Sabha Speaker Sumitra Mahajan and she had ordered Ethics Committee to probe on the matter. The Ethics Committee headed by L K Advani had sought a response from Rahul Gandhi. In Rahul’s reply, he never explained why he has declared himself as a British citizen and made evasive replies that none can doubt his Indian origin.
However, the Ethics Committee did not proceed on this sensitive issue, forcing Swamy to approach the Home Ministry in September 2017. Recently the Returning Officer of Amethi said that Citizenship does not come under his purview and it is for the Home Ministry to take action.
