The Marxist-dominated lawyers’ body of Kerala High Court humiliated and insulted the outgoing Chief Justice because the latter was bold enough to ask unpalatable and bitter questions to the CPI-M led government of Kerala and the arrogant advocates of the Court who did not have the answers to his probing questions. Thomas Abraham, a Christian fanatic masquerading as a Marxist fellow traveler is described as the master brain who led the mafia of lawyers against Chief Justice Navnithi Prasad Singh and denied him the Full Court Reference.

The court ordered that if any student was found resorting to and staging dharna or strike or disrupting the academic atmosphere of any college, the Principal or the authorities of the institution would have the right to “rusticate them”, for these were no means to ventilate their grievances.

Justice Navnithi Prasad Singh, who was sworn in as Chief Justice of Kerala on March 2017 laid down office on November 5, 2017, on reaching the age of 62. During his brief tenure Chief Justice Singh had made some of the landmark judgments as well as historical observations which literally shook the cabals and coteries controlling the Kerala society. This resulted in Chief Justice Singh being denied the full court reference accorded to all Justices on the day they leave the Court.

An order delivered by the Division Bench of Kerala High Court on October 13, 2017, and which was ignored by the national media, had antagonized the Marxists and the anarchists in the country. The Division Bench consisting of Chief Justice Navniti Prasad Singh ruled that politics has no place in campuses.

While pronouncing the verdict of a contempt of court petition filed by MES College Ponnani against the Marxist-controlled Students Federation of India (SFI) cadre for staging demonstration in the college campus in spite of a court order, the division bench headed by Chief Justice had ruled that political activities such as dharna, hunger strike, and practices such as satyagraha had no place in a constitutional democracy, much less in academic institutions. “Educational institutions are meant for imparting education and not politics. Political parties could not hold to ransom educational institutions or the right of civilized students to receive education,” the court ordered.

The order further said that the parent of the student who indulged in campus politics must consider whether their ward was going to the college to involve in politics or to study. “If students had legitimate grievances, avenues for ventilating them are legally available. There is the student council, academic council and there are courts, including this court, where their grievances could be raised,” Chief Justice Singh said in the order.

When the lawyer appearing for the SFI told the court that students were only staging dharnas and hunger strikes outside the college, the court said that staging dharnas would only vitiate the academic atmosphere.

The court ordered that if any student was found resorting to and staging dharna or strike or disrupting the academic atmosphere of any college, the Principal or the authorities of the institution would have the right to “rusticate them”, for these were no means to ventilate their grievances. The police would be under an obligation to assist the authorities in maintaining peace and orderly conduct of academics on the college premises if they were called upon by the college authorities.

This was a classic example of how Justice Singh became a household name in Kerala and earned the adulation and admiration of the teaching faculty as well as parents. Justice Singh came to Kerala with a fantastic track record including the path-breaking verdict he delivered as a judge in Patna High Court quashing the prohibition in Bihar.

Justice Singh, a no-nonsense judge became a thorn in the flesh of some of the lawyers who came to the court without preparing for arguments. What antagonized Thomas Abraham, an ordinary lawyer with no expertise in any branch of law was the denial of a chair to him in the podium along with other VVIPs when the President of India Ram Nath Kovind came down to Kerala to inaugurate the centenary of the Kerala High Court.

According to sources in the Chief Justice’s office, Thomas Abraham asked Justice Singh to arrange a chair in the stage to sit along with the President of India and Chief Justice of the Supreme Court. When Justice Singh told the lawyer that he was helpless because the protocol was being looked after by the offices of the President of India and the CJI, Thomas Abraham is reported to have abused Justice Singh in filthy language unbecoming of an advocate practicing in the court. After this incident, the Chief Justice received many anonymous letters abusing him in the most filthy language. These letters were believed to be written by Thomas Abraham because of the pattern in the language used in the letters.

Veteran advocates in Kerala High Court told Team PGurus that the insult meted out to Justice Singh was an unfortunate incident and speaks of the low quality of the present day lawyers practicing in the court. “Had Justice Singh been elevated as a judge of the Supreme Court, the situation would have been different. The same Thomas Abraham would have fallen flat in front of Justice Singh. But he was retiring from the bench and the likes of Thomas Abraham chose to strike at that point in time. The other judges in the bench should take note of the attitude of Thomas Abraham,” said a senior lawyer.

Sangeetha Lakshmanan, an advocate practicing in Kerala High Court in her Facebook posting had mentioned about the obnoxious behavior of Justice Sivarajan, a former judge of the KHC who probed the Solar Scam involving former chief minister Oommen Chandy and Saritha Nair. “Sivarajan was a sexually perverted judge who always used filthy language while presiding in the courtroom,” said Lakshmanan in her posting. Justice Singh survived in the bench consisting of such questionable characters like Sivarajan.
