Without providing their own documents or getting ready to testify, Congress leaders Sonia Gandhi and Rahul Gandhi accused senior BJP leader Subramanian Swamy of trying to delay the case by asking for a series of documents.

The BJP leader had filed a set of documents of around 450 pages reportedly relating to the Congress party, National Herald and others before the court, seeking a response from the accused as to whether these were correct.

For the past two years, Congress leaders are not providing any documents of their party’s funding to Associated Journal Limited (AJL) or the accounts of AJL or Young Indian or the Congress party which itself exposes the scam. After hearing the objection of the leaders Metropolitan Magistrate Ambika Singh posted the case on January 20 for further arguments.

Puncturing Congress leaders repeated objections in producing their own documents, Subramanian Swamy, in the previous hearing made an application under Section 294 of CrPC. As per this Swamy can produce those documents and Congress leaders can be asked to cross verify these documents. This was a nightmare to the Congress leadership as these documents will boomerang on them and can cut short many procedures in the trial. On November 18, sensing this lethal way, Congress leaders argued that Swamy is trying to delay the process by moving many petitions while withdrawing many of his earlier petitions.

“This exercise undertaken by the complainant to file multiple applications, choosing to withdraw some and further choosing to change the relief sought in one by replacing it with another is nothing but an absolute disregard for the precious time of this court and of the larger judicial process,” said Sonia and Rahul in their counter arguments on Swamy’s petition under Section 294 of CrPC for cross verification of National Herald case documents. The leaders sought dismissal of Swamy’s application while keeping silence on the production of their own documents or cross verification of their own documents produced by Swamy.

  1. Amongst others I find it extra ordinary that the court should schedule the hearing for another two months.!! This case does not seem to be heading anywhere. And if the the electoral outcomes are otherwise then this case will die a natural death. In fact not one of the corrupt UPA government has been punished so far. Peoples patience is running out and will reflect on the governments inability to fight corruption.

  2. This how they have been managing this country over 65 Years. The very fact that they are I. Power for over six decades indicate that they will have tremendous influence in the administrations and even in judicial process. That is the real irony.

    • If these corrupt Gandhi family do not provide important documents then it means that they are guilty of corruption and hence the SC must render the justice as guilty and put them behind Tahir jail. People have suffered enough from them and their devious tricks done through their submissive lawyers and senior party members. Also their administrative and justice moles must be purged and dismissed from the Government positions ,just like what is done in Washington USA.

      • Furthermore, government must pass the law like the one passed in Australia that prevents sitting members of parliament who have dual citizenship to be members in parliament. Are these people of Indian citizenship or not. Verify further their status now and soon.

  3. This can be expected. The mother son doo as well as the congress party would try every trick in the law books and also tricks not in law books to escape their due desserts. But Swamy is a hard nut to crack and unrelenting in the pursuit of the case. Rahul and Sonia may allege What they are advised to by their lawyer shysters but they meet more than their match in Swamy. Court cases drag on in this country as the procedural laws come in handy for delaying and defeating justice. Patience is the watchword to reach the winning line.

  4. In cases like NH where prima facie case has been established, if the onus of proof of innocence is placed on the accused, the case will be decided in no time.

    We should explore filing a PIL on this issue. Retired Judge Sri. T. Vallinayagam and such eminent people with similar views may also be co-opted in filing the PIL.

  5. As a BJP sympathiser I am really worried that so many rats are taking place and BJP workers are jubilant but goes silent and nothing happens. Not one punished solar by this govt. Modi boasts that the custodian on public money. I am sorry for the state of affairs. The court is also responsible.On the whole the people are cheated.People like Swamy waging lonely battle. God will give him a strength

  6. Time for CBI, ED and Income Tax to act. Why Government is becoming a mute spectator in the National Herald case, leaving Subramanian Swamy alone to fight it as a private complaint. This is a matter of land and properties worth 5000 crore grabbing by Sonia Gandhi and family. Not alone a fight of Swamy. Government should act as up to Supreme Court, all Courts found wrongs in the National Herald land grabbing. Narendra Modi should take call on this
