Rajasthan High Court on Wednesday stayed the arrest warrant issued by a trial court against Arun Shourie in the Udaipur Laxmi Vilas Hotel disinvestment case. Yesterday the High Court had slammed the trial court in Jodhpur for passing a controversial order against the CBI’s closure report in the case by giving relief to Bharat Hotel Group owner Jyotsna Suri[1].
Arun Shourie (79) who appeared online along with his advocate Prashant Bhushan narrated the entire process of the disinvestment, which was approved by the Law Ministry and Union Cabinet approved during Prime Minister Vajpayee’s tenure in 2001. Shourie also requested an exemption from personal appearance. Both Shourie and Bhushan pointed out the gross errors in the trial judge’s Order. He narrated his old age problems and the situation of his ailing wife and son. The court granted him relief by allowing him to appear anytime before October 15, by ordering no arrest[2].

CBI also supported Shourie’s arguments and pointed out the errors in the trial judge’s controversial Order. It must be interesting to note that CBI under Prime Minister Narendra Modi’s regime registered this case and later in 2019 decided to close the case. However, the trial judge did not agree to close the case and passed the controversial order of arresting Arun Shourie and others. The Judge also ordered the seizure of the Hotel.

It is still a mystery as to why the CBI under Narendra Modi registered an FIR on a Vajpayee Government’s Cabinet decision. Inefficient minster is holding Law, IT and Telecom portfolios! Without PM and HM nod such sad events do not occur.
Education gives us good Samaskar/Culture. Post 2014 May/June elections resulted in BJP/RSS disrespecting erudite scholars, experienced gentlemen and abusing old age within their own party/ranks and less said the better about outsiders. For instance few weeks ago BJP IT cell coolies started abusing Dr.S.Swamy!! Dividing Hindus within their own rank and file, but sheds loads of tears saying BJP lost this or that MLA/MP seat by a whisker/less than 100 votes/less than 1000 votes and likewise!! Hall mark especially during second term of BJP lead NDA Govt is to brand everyone as anti-national and double compliance costs!!
This CBI filing the case was the inner circle tussle between the then CBI chief and other staff just below him – which finally resulted in sacking the then CBI Chief- during the previous SC CJI Gogoi. That is why the case went under the papers of 6 yrs in CBI platform, when they realized to close it. But Lower Court must have some one committed to Pappu try to ignite a controversy between Modi and Vajpai Govt. This might be handy work of Congress pet dog & Rajasthan CM Ghelot – as revenge on BJPfor the drama he created with his Dy CM.
There is no quality in administration for over six years now. This avoidable episode speaks volumes about how PMO is preferably structured and liked to be functioned and is supervised by whom….the Cabinet Secretary? Principle Secretary? Personal Secretary? or some extra constitutional person/lobby?
Disgusting that the PM and a section of the Law machinery stoops to a new low to settle person detract. Shourir still remains a hero journalist in the eyes of many who read his investigative journalism in th 80s. Give a thought to the man’s age, his contributions , the sad state of his wife and son.
