With the Delhi Police (DP) informing Supreme Court that it will be filing the Final Report within a week in the trial court, finally, the wheels of justice have started moving for Sunanda.  Due to his power and unholy nexus cutting across the political spectrum and cricket administration controlling political leaders, the husband and former Union Minister Shashi Tharoor was evading from the law[1]. It is learned that Shashi Tharoor is expected to be charged for non-bailable provisions like abetment to suicide (IPC 306) and attempts to sabotage the investigation in the case[2].

Swamy approached Supreme Court after the Delhi High Court’s Bench headed by Justice Muralidhar, on its first hearing unexpectedly rejected[3] the petition in October 2017.

The Delhi Police was forced to act on BJP leader Subramanian Swamy’s appeal in the Supreme Court. DP on Monday informed that their draft Police Report was vetted by the Prosecution Department of Delhi Government and received back on May 5.

“The Prosecution Department of GNCT of Delhi (Delhi Govt) has made some important suggestions and has tendered valuable advice to the SIT to further improve the draft Police Report from the legal perspective before it is submitted for adjudication by the Trial Court of the competent jurisdiction.

“The process of incorporating the suggestions/ amendments as advised by the Prosecution Department is under process and upon completion of the same, by all means not alter than a week from this date (May 7, 2018) the appropriate Police Report shall be submitted before the Trial Court of competent jurisdiction for consideration and concomitant judicial proceedings,” said Delhi Police in a affidavit filed before Supreme Court.

Swamy approached Supreme Court after the Delhi High Court’s Bench headed by Justice Muralidhar, on its first hearing unexpectedly rejected[3] the petition in October 2017. Justice Muralidhar’s judgment is widely considered as a bad one, aver many legal experts. Earlier the petition was heard by Justice Sistani-led Bench and Delhi Police was given a fixed time to finish the probe in eight weeks and the Bench after its four-time hearing said that cricket betting in the Indian Premier League (IPL) angle would also be considered. But in the next hearing, the case was posted before Justice Muralidhar, who on the very first day of the sitting, even without allowing Swamy to argue, dismissed the petition. There was a huge argument between Swamy and the Justice Muralidhar, who termed Swamy’s petition as a classic case of a politically motivated petition. The Judge even said that Swamy did not declare in the petition that he was a member of the Bharatiya Janata Party (BJP) and Shashi Tharoor was from Congress. At one point, Swamy reminded the judge that, he was Law Minister and doesn’t need lessons in drafting petitions.

It is still a mystery as to why Justice Muralidhar ignored the aspect of an inordinate delay by the Delhi Police, which had filed the First Information Report (FIR) in January 2015, a year after Sunanda’s mysterious murder. In his appeal before the Bench headed by Justice Arun Mishra, Swamy said that the Delhi High Court’s Judgment pronounced by Justice Muralidhar led Bench was totally erroneous and ignored the aspect of Delhi Police delay in finishing the probes, citing the All India Institute of Medical Science’s (AIIMS) reports clearly showing that Sunanda’s death was by poisoning[4]. The Supreme Court in its second day of hearing issued a notice to Delhi Police, which forced them to finish the probe, which has been languishing for a long time.

  1. Even now congress can manage and save Sashitharoor and his cronies. Hope Sunanda will get justice to make her soul rest in peace.
