The mysterious death of Sunanda Pushkar has taken a major turn with the Bharatiya Janata Party (BJP) leader Subramanian Swamy filing a petition in the trial court on Wednesday, for summoning the Delhi Police’s Vigilance Report indicting the first probe team for gross faults and violations. Additional Chief Metropolitan Magistrate Samar Vishal has posted the petition for hearing on June 5, the same day the Court is also expected to take cognizance of Delhi Police Charge sheet accusing husband Shashi Tharoor.
It is learned that many officers in the initial probe team revealed to Vigilance that they were forced to act as per the directions of Vivek Gogia, who was ruling the roost in Delhi Police during UPA tenure.
Swamy in his petition cited media reports[1] on Delhi Police’s Vigilance Report exposing the blatant violations and faults committed by the first probe team headed by the then Joint Commissioner Vivek Gogia. In his petition, Swamy said that the Court should summon the Vigilance Report in the interest of justice.
As per media reports, the Vigilance Report has listed out more than 10 blatant violations committed by the first probe team under Vivek Gogia. It is learned that the Report indicted him severely for serious lapses in Sunanda’s mysterious death.
As per the Vigilance Report, the Investigating Officer was allowed to collect the bed sheet, bed covers and some eatables from the room where Sunanda’s body was found, some ten months after the incident. The mobile phones and laptop of Sunanda were taken to Dubai by her son, Shiv Menon after her last rites. The Delhi Police seized her laptop on January 25 and her three blackberry phones on January 30. These were handed over to the Delhi Police by Shiv Kumar Prasad, Shashi Tharoor’s consultant. Highly placed sources said that the vigilance report mentions that it is one of the five shortcomings as some of the data was found to be deleted from Sunanda’s phone. The Report also said that the phones were given to Shashi Tharoor by none other Joint Commissioner Vivek Gogia on the very next day of death.
One of the key shortcomings mentioned in the Vigilance Report is that the Special Investigation Team (SIT) is yet to establish the source of the Alprax tablets[2]. The probe team is yet to match the Alprax tablets with the batch numbers of the recovered Alprax tablets seized from the crime spot.
It is learned that many officers in the initial probe team revealed to Vigilance that they were forced to act as per the directions of Vivek Gogia, who was ruling the roost in Delhi Police during UPA tenure. Even after repeated reminders from the All India Institute of Medical Sciences (AIIMS), the bed sheets and pillow covers were not handed over by Delhi Police till November 2014[3].
“A Vigilance Inquiry was ordered by Commissioner of Police into the lapses committed during the initial investigation. It has to be appreciated that very rarely does the Commissioner of Police direct such a Vigilance Inquiry of his own force,” said Swamy in his petition citing the Vigilance Inquiry initiated by former Commissioner Alok Verma, the current CBI Chief.
“It is most respectfully stated that if this Honourable Court examines these shortcomings pointed out in the Vigilance Report to the extent whether the investigating agency (Delhi Police) has considered these shortcomings prior to the filing of the charge-sheet, further investigations on the conspiracy and other angles may be carried out in the interest of justice. It is stated that the filing of charge-sheet is not supposed to be a routine document but on the basis of proper investigation,” said Swamy demanding the production of Vigilance Report by Delhi Police.

This fellow Vivek Gogia has to be punished. Irrespective of the court proceedings, the Judge should send Tharoor to the jail (life imprisonment) & it should supported by Supreme Court (at later stages of appeal process).
Our words will not be enough to thank SSwamy ji. May god give him long life and more energy so that all corrupt people are put behind bars.
Fighting these legal cases, consume lots of time, energy & money. Do not know if Dr. Swamy has any helping team or not. He is the only true India amongst all corrupt policitians. He will have his place in heaven.
