Sunanda Pushkar murder:  Supreme Court notice to Delhi Police on Swamy’s plea for SIT probe

The Supreme Court has asked the Delhi Police to submit a status report on the murder of Sunanda Pushkar

The case over the murder of Sunanda Pushkar has revived again. The Supreme Court on Friday sought the response of the Delhi Police on a plea filed by BJP leader Subramanian Swamy seeking a Special Investigation Team (SIT) probe into the death of Congress MP Shashi Tharoor’s wife Sunanda Pushkar. The bench of Justices Arun Mishra and A M Khanwilkar issued a notice to the police on Swamy’s plea, leaving open the question of maintainability of the petition.

“Keeping the question of maintainability open, let a notice be issued,” the bench said. In his brief argument, Swamy pointed out the gross illegality in the Order of Delhi High Court passed by Justice Muralidhar. Swamy said that earlier the petition was heard by Justice G S Sistani and orders were passed in mid-September 2017 to Delhi Police to submit detailed probe status report by October 30.

Swamy pointed out that in the meantime the roster was changed and the case was posted before Justice Muralidhar, who on the very first day of hearing on October 26 dismissed the petition. The BJP leader said that he was not given a chance to argue and the Delhi Police status report expected to be filed in few days was also not considered.

Somehow, Justice Muralidhar did not go to the issues on the Sunanda murder and rather preferred to term Swamy’s petition as politically motivated. The High Court order even observed that Swamy did not mention himself as BJP member and Shashi Tharoor as Congress Member. In the legal world, it is still a mystery how the Judge had come to a conclusion and wound up the petition in his first sitting that too without hearing the petitioner or not looking into the earlier orders.

Now after Supreme Court’s notice, Delhi Police is again becoming accountable to the murder case involving IPL Cricket scams involving high profile criminals.
