In a bid to seek a clarification from the Defence Ministry, BJP leader Subramanian Swamy moved a notice for a debate in the Rajya Sabha under Calling Attention Motion on the First Information Report (FIR) filed against the Army officials in Jammu and Kashmir by the state police. Swamy’s move came after the Chief Minister Mehbooba Mufti declared in the Assembly that she got a clearance to register an FIR against Army officials from the Defence Minister Nirmala Sitharaman[1].

If the Defence Minister is convinced that naming Major Aditya is not wrong she must share details how many such FIRs were filed in the past where the army officer was named even before initiating the probe.

For the past few days Swamy has been seeking a clarification from Nirmala about Mehbooba’s claim. Ms. Sitharaman, who is media friendly and an expert in giving multi-lingual bytes has gone totally silent on this issue. The fact of the matter is that the area Shopian – where the Army forced to retaliate against the Jihadi stonepelters comes under the Armed Forces Special Powers Act (AFSPA). Under AFSPA implemented areas, an FIR or any action against the Army can initiated only with the consent of the Defence Ministry[2].

It is not a given that the Rajya Sabha Chairperson Venkaiah Naidu will approve the sensitive Calling Attention Motion moved by Swamy, which will force Nirmala to speak. Swamy has already declared that he would raise the issue and seek Nirmala’s clarification on Mehbooba’s claim in Rajya Sabha. On Friday he attempted to raise the issue during the Zero Hour, but could not as the House adjourned over other issues.

In Zero House submissions, the Government is not mandated to reply. But if a Calling Attention Motion is allowed Government must respond. On Saturday, Swamy tweeted that Prime Minister Narendra Modi should direct Nirmala to clarify on Mehbooba’s claim.

For the past one week, the Defence Minister is tweeting her meetings with Army, Navy and Air Force stations in uniforms. But giving a clearance to the state government to register an FIR against her boys has dented the image of the Defence Minister. No Defence Minister of this country has ever given clearance to register FIR against the Armed Forces acting in the line of their duty. If the Defence Minister is convinced that naming Major Aditya is not wrong she must share details how many such FIRs were filed in the past where the army officer was named even before initiating the probe. Nirmala owes an answer to the Nation.

  1. Quite otherwise Ms Nirmala Sitaraman is a capable minister. But if she has given GO AHEAD to chief minister then she has no moral right to continue in that post. It is demeaning the very forces that she is heading. Her silence on the matter makes us more uncomfortable and make us believe that what appears in the news to be true.

  2. If the Defence Minister has indeed given clearance for filing FIR against our Army, it is a serious matter; either the Centre has given in to the State (where minorities are in majority) or the DM had committed a blunder which warrants her resignation whatever the alleged facts are.

  3. why is she quiet all this time. She is quiet even after Dr SS has moved a calling attention motion. She acts as if she is more loyal than the King and I think her elevation as DM has
    gone to her head. She must put in her papers forthwith.

  4. Nirmala Sitaraman is too smart a lady to talk & permit nonsense to Mufti Mehbooba Sayeed, who in past has spoken & given false statements.
    Wait for Nirmala Sitaraman to give a fitting reply …. ice mountains will fall on Mufti for rest of her life

  5. Matter should be viewed seriously by the Modi Sarkar or else the people will take their view which will effect the 2019 election result. Modi Sarkar failed to take effective view on SC judges case also failed to take any action against the central minister , taking oath to saveguard the sovereignty of the country , who misled the supreme court in the Gujarat encounter case. People are taking their views.

  6. Ms Sitharaman may be an efficient Minister, but if she has indeed permitted the FIR against MajorAditya she must be asked to resign. Period. If Modi does not, there is a lot of smoke within which might lead to a fire and eventually to a political conflagration, which Modi may find difficult to control.
