Senior BJP leader Subramanian Swamy urged Prime Minister Narendra Modi to order a probe on the issuing of dubious Circular by the Central Board of Direct Taxes (CBDT) on December 31, 2018 to save Sonia Gandhi and Rahul Gandhi from the Income Tax implications in the National Herald case. In a letter, appreciating Modi for the prompt action of the withdrawal of the circular on January 4, Swamy said there should be a probe to find out who asked the Under Secretary in Ministry of Finance to issue this dubious circular to save the Gandhis from tax probes.
The mere fact that in 24 hours, the Circular was withdrawn shows the great concern felt by the Government about the damage likely to be caused by this and hence the Government wasted no time to withdraw the Circular.
“You have given importance to this National Herald case by announcing in the public several times that Sonia Gandhi, her son Rahul Gandhi and four others are presently out on bail and therefore lacked morality to speak about corruption. This is a well-taken point, and I congratulate you for bringing the matter before the general public,” said Swamy pointing out that the dubious CBDT circular was issued to demolish his case as well as the Income Tax’s case.
He said that this Circular was issued by “traitors” with the help of pliable officials to save Gandhis from the crime of forming Young Indian and take over the 99.9% shares of the National Herald publishing firm Associated Journals Limited in an illegal way.
“This is an extraordinary unprecedented event, that a Circular (dealing with such an extraordinarily important matter impinging on the fight against corruption) should be issued to casually and withdrawn within a matter of 24 hours. It means that the original Circular dated December 31, 2018, and made public on January 3, 2019, was either an act of gross stupidity and incompetence (which is not likely), or probably that it was a command performance by the Finance Ministry Under-Secretary who signed the Circular. The mere fact that in 24 hours, the Circular was withdrawn shows the great concern felt by the Government about the damage likely to be caused by this and hence the Government wasted no time to withdraw the Circular. But it is important to know the Circulars are prepared through a process in which many participate,” said Swamy, seeking an Inquiry Committee under Dr. Jitendra Singh, Minister of State in PMO.
“Obviously the first Circular was to help Sonia Gandhi, Rahul Gandhi and other four accused to escape from the National Herald case. What was the quid pro quo for this action of the Ministry of Finance officer? The signing officer should be interrogated on who advised him/her to sign this Circular,” demanded Swamy, main petitioner in the National Herald case.

Sir, as per HonSC directive to Sonia and Raga around January 4, they were to seek clarification from the CBDT by 11th, to be followed by reply within Two weeks from the IT department.
It’s almost 5 weeks now and the Public are in the dark as to why, HonSC hasn’t called both the parties to proceed further with the IT case on Sonia and Raga.
It appears, some are always more than equal in our judicial system.

Really sad to read still under NDA govt allowing corrupt politicians to run away due to planted crooks in FM/HM/PMO.
My humble suggestion to Dr.S.Swamy is to “resign” from BJP and to his RS membership and give a big “shock treatment” to BJP first and PM Modi. Because every time Dr.S.Swamy has to write a letter to PM or chase cases on corruption and “reminding PM ” to do this or that and let BJP loose elections few months away or fall short of majority. Why PM is so poor in administration? But his speeches are very brave and bold on corrupt people!!
My hunch is that BJP/PMO already got Chistian Michel in custody,nearly won the case against Mallya, before elections may succeed on Nirav and Choksi also and give big hype in the media on them and in the melee “duck cases” on PC, KC, SG, RG et al…..and blame the judiciary for delays. Any how these big four have considerable network and can influence anybody!!

We can understand BJP’s disinterestedness or go slow attitude on corruption and certain anti-nationals. If BJP falls short of majority in the ensuing elections and later form government with over a “dozen crutches” deal may be struck to water down cases on PC,KC,SG,RG…..and blame on “coalition dharma…..pulls and pressure”. Is this what BJP trying for since, it lack the guts at the end?
It is time that some newspaper voluntarily publish the letter of Dr. swamy to put pressure on BJP govt for playing tricks !!! Arun Jaitely or whoever it is should be identified & punished.

I dont think any one without the concent of Finance minister would have issued. Hence an enquiry to be instituted and seek the truth and the guilty to be punished even if sanction is needed to institute to proceed with criminal case. The guilty is not only obstruct truth and he is the traitor.
Inspite of the passage of almost one term for NDA, still the Congress is having enormous influence in all Institutions who are facilitating escaping route for corrupt Congress. It is the Almighty alone can punish the sinners.
Looks like even the Justice system in on the side of corruption as they are given bail after bail.

Without Finance Minister Arun Jaitley’s knowledge, such Circulars won’t be issued. No further comments. This is like the dilution of Citizens’ Act by bringing an amendment on early 2004( the fag end of Vajpayee regime) which made Sonia Gandhi equal to Indian born Indian citizens. That was NEVER the intention of this Delhi smart-man, Arun Jaitley, who is all out to get his share of the big-fat retainer fee for all the work he does everyday. He has to save and look after his high end Bureaucrats, judges, circle of pseudo-top lawyers who are mere lobbyists, coolies of Corporate honchos, collecting their crumps. Given the above, is it not his interest to protect his companion across the party line, Mr. P.Chidambaram along with his party , Rahul-Sonia, Vadra across the party lines? Yes, he has to. Moreover, this big mouth Subramanian Swamy is a nuisance and he has to be contained at all costs and for this STALL National Healr, IAircel-Maxis and other high profiile cases. Keep Modi busy in the international circuits. In the end, country, corruption matter least.OR is this all happening with Modi’s Nod? Time alone can tell. Like J. If Modi government does not do that Dr Swamy should take to the court
