For the past week, many Left-leaning websites are publishing negative stories against Justice Arun Mishra, who retired on September 2, while ignoring the bold judgments delivered by him. The Left has this uncouth habit of maligning those not on their side. Justice Arun Mishra is not on the left side and his political ideologies as an Advocate and as a Student were Right oriented. But as Judge, he produced great and bold Judgments like in the case of demolition of illegal flats in Kerala, Telecom AGR dues case Judgment which brought Rs.1.65 lakh crores to the public exchequer.
Left portals like the Wire have faced heat from Justice Arun Mishra in the defamation case filed by Home Minister Amit Shah’s son and at last, the website withdrew their petition. Noted lawyer Prashant Bhushan and Arun Mishra first locked horns in the Court during arguments on the medical college scam. Bhushan wrongly called sitting Chief Justice of India Dipak Misra as an accused in a CBI FIR and got slapped with a fine of Rs.25 lakhs. The latest was the Contempt of Court case where Bhushan was found guilty.
Justice Mishra who joined as High Court Judge in 1999 was supposed to be the Chief Justice of India from August 2017, after the retirement of Chief Justice of India J S Khehar.
Another mudslinging is from the CPI(M) controlled portal News Click. They wrote an article saying Justice Arun Mishra helped Adani Group by favorable Judgment. Justice Mishra only ratified the verdicts of lower courts in a petition related to power tariffs. Adani won in all forums because Governments changed laws to favour the power tariffs. The petition was filed by an association of Engineers. So, if Justice Mishra was so corporate-friendly, why did these Left writers not see his judgments in the Telecom sector where all the Corporates from Tata to Ambani to Birla got hit and were forced to pay Rs.1.65 lakh crores to the exchequer?
It was because of the boldness of the Bench headed by Justice Arun Mishra that such a large amount of money has landed in the public exchequer. Even the Government played fraud in the case and allowed a 20-year installment package, which was cut short to 10 years by the Court[1].
Like the Left gang, the former corrupt Finance Minister P Chidambaram also hates Justice Arun Mishra. It was Justice Mishra who gave a timeline of six months to CBI and ED finish the probe and file a charge sheet in the Aircel Maxis Scam in Subramanian Swamy’s petition. Swamy filed the petition in May 2012 and the case went to many Judges and at last, after five years in late 2017, Justice Arun Mishra’s Bench ordered CBI to finish the probe and file a charge sheet in Aircel-Maxis Scam within six months. Delhi Police was forced to file a Chargesheet on the Sunanda Murder case against Shashi Tharoor in 2018 after the notice was issued by Justice Arun Mishra’s Bench in Subramanian Swamy’s petition. These incidents show the boldness of Justice Arun Mishra and who are his enemies and their bandwagon.

It is well known that due to ideological differences, Justice Mishra was not elevated to the Supreme Court during the Congress regime.
Justice Mishra is a bold Judge which is evident from the demolition order of illegally constructed flats in Kerala, where all Governments tried to save the builder lobby. Justice Mishra later described that the demolition of flats was “painful duty”[2].
Before becoming Judge, Arun Mishra was actively involved in Bar Council activities and his leanings were associated with Right-Wing Advocates’ associations. It is well known that Bar Council elections are mostly fought on political lines and the Left and Congress also have their own Advocates’ Associations. Everybody above 18 years of age has their own political line. But blaming a Judge based on his previous political leanings is bad and uncouth. Left parties always have this problem. If anybody from their opposite association becomes a Judge they start slandering and if from their gang, they praise them to the skies. For instance – Justice V R Krishna Iyer was a Minister in the first Communist Ministry of Kerala before becoming a Judge. But there is a narrative created by the Left that Justice Krishna Iyer is the last word in law, while ignoring many of his debatable Judgments in many sensitive cases like giving escape route to Indira Gandhi from the famous Allahabad High Court Judgment, which declared her election as illegal violating electoral guidelines. We recently saw a Judge trying to save Naxals who are his wife’s ideological colleagues. And we have seen the Left praising that Judge in so many words.
The Left gain is always like this. If you are not on their side, then better be prepared to face mudslinging. It is a known fact that many Judges are also Left oriented. PGurus recently published an article on the duplicity of the Left and so-called Liberal networks in Contempt cases when it comes to Prashant Bhushan and Right Winger Gurumurthy[3].

What kind of article is this? For the author, anyone opposed to religion based politics is a leftist. An educated person who is above religious considerations is a liberal leftists and because this person is above religious consideration, he/she is uncouth. These false definitions of who a leftist are deliberately repeated million times in the hope of getting them some legitamacy. A judge who throws all best practices expected from a judge to winds and praises a PM who is considered a divisive figure by many, whose grand son’s tonsure ceremony is attended by the PM & HM and who dismisses the case of Judge Loya’s death under mysterious circumstances when he was investigating a murder case against the current Home Minister of this country cannot be given the benefit of doubt on where his loyalty lies. As the saying goes, it is just not enough for a judge to be not supporting a political ideology or a political party, he/she should be seen as not doing it.
It is the violence of the leftists like Stalin who killed millions that needs to condemned. A government that wants to create a level playing field between the have and havenots is in principle leftist. A government that taxes incomes of some of its citizens and does direct benefit transfer to others is leftist. All social welfare schemes of the government are leftist. Public sector organizations is an example of leftist ideology. As far as pgurus is concerned, the new definition of leftist is “Anyone who opposes the Modi led BJP government at the center”.
P G Gurus needs to write one more article appreciating this corrupt Mishra as a genius SC Judge after the ruling regime awards a “Pre-fixed-Post-Retirement” job + Y-Security for all his unbised judgements.!

I liked his catching Pativratashiromani BJP lead NDA behind the deals with regard to AGR dues sweeping under the carpet attempts while its silent supporting Congress-I looking the other way!!!
As far as I know for over six plus years BJP lead NDA did very little to dismantle Judiciary Collegium system nor tried for judicial reforms. Left-Liberati-Congress-I hold and influence will continue and their websites unleash mudslinging. Merit is not respected nor preferred either in the ministry making nor elsewhere.

Pgurus is unnecessarily giving importance to such websites by reiterating their BS. People are smart to discern what is good for country and give their verdict in elections. History tells how they punished Indira Gandhi after emergency despite Indira Gandhi getting help from pliable judges. My suggestion to Pgurus is ignore the BS dished out by the so called left oriented websites, which have hardly any readership among real voters of India. Highlighting those sites only makes them credible.
