The US Supreme Court has declined an appeal from the Biden administration, effectively upholding a lower court ruling that prohibits hospitals in Texas from performing emergency abortions that would violate state law. This ruling comes amid Texas’s stringent abortion regulations, which are among the strictest in the nation.

On Monday, the justices chose not to dissent publicly, allowing the lower court’s decision to remain in effect, as reported by Xinhua news agency. The ruling states that hospitals cannot be mandated to perform pregnancy terminations that conflict with Texas law.

The Biden administration had contended that under federal law, hospitals must perform abortions in emergency situations. The Justice Department pointed to a Texas Supreme Court ruling that indicated that doctors are not required to wait for a woman’s life to be in imminent danger before providing a legal abortion. According to The Texas Tribune, this interpretation was argued to align Texas law with federal standards, thus rendering the lower court’s ruling unnecessary.

The Supreme Court’s decision arrives just weeks ahead of Election Day, where abortion rights continue to be a pivotal issue following the court’s 2022 decision to overturn the nationwide right to abortion. In Texas, Republican Senator Ted Cruz, a prominent anti-abortion advocate seeking a third term, faces increasing dissent within his party, as his Democratic challenger Colin Allred has made restoring abortion access a central theme of his campaign.
