Justice Dr Bulusu Siva Sankara Rao – former Judge, High Court for the State of Telangana at Hyderabad and presently officiating the post of Judge, Judicial preview for the state of Andhra Pradesh at Amravati wrote a letter to the President of India, Shri Ram Nath Kovind on the spirit and principles of Indian Constitution, Constitutional morality – Raja Dharma, article 363 and rights of the Hindu deities.
He says that as per the constitution, a Hindu deity is a legal and individual entity/personality from Prana Pratishta to say as good as a living being, but like a minor, the properties are under management and care of a trustee – another living being. Therefore, in his letter, he argues that any harm to a Hindu idol in any manner is not mere harm or damage to an article or an artefact but harm to a living minor being.
He writes this letter in the context of recent attacks on the Hindu deities in the state of Andhra Pradesh. he also writes about his attempt to approach the issue on constitutional morality in Chilkur Balaji – Article 363 of the Constitution of India – on deities rights issue with the same spirit.
As per sec 143, this case cannot be taken to Supreme Court anymore, therefore, addressing the issue before the highest authority of nation who will be able to provide a remedy.
