The ‘malicious’ campaign unleashed by the Kashmir centric media houses and their sympathisers sitting in the newsrooms in New Delhi received a severe jolt on Thursday after Bar Council of India informed the Apex court in clear words that the lawyers had not obstructed justice in the Kathua rape case and their demand for a CBI investigation into the matter was “justified”.

A five-member team of Bar Council of India led by a retired High Court Judge had earlier visited Kathua and Jammu before submitting their report to the Supreme court.

The team, comprising former BCI chief Tarun Agarwal, BCI co-chairmen S Prabakaran and Ramachandra G Shah, and members Razia Beig of the Bar Council of Uttrakhand and Naresh Dikshit, an advocate, also met the members of Jammu and Kathua Bar Associations and noted their viewpoint.

BS Slathia, president, J&K High Court Bar Association, Jammu said there was a complete “distortion of facts” by the national media vis-à-vis their strike for deportation of Rohingya refugees and withdrawal of controversial minutes of the Tribal Affairs Department.

In Jammu, the five-member team also met members of the civil society in Jammu to get a clear picture of the sequence of events. The panel had also visited the court of District and Sessions Judge and interacted with the local lawyers in Kathua.

They arrived here after the top court had taken suo motto notice of media reports which highlighted the wrong picture that the lawyers in Kathua had obstructed the delivery of justice in the sensitive trial.

As the vested political interest is prevailing and guiding the ruling partners who had so far shied away from recommending CBI probe in the matter there is growing clamor for the same from local residents in Jammu.

Knowing the history of high profile cases where politicians and top bureaucrats had earned clean chits the local residents have apparently lost faith in the justice delivery system and believe only a CBI probe can give justice to the minor and her family.

The PDP-Congress Govt had handed over the case to the CBI in which top bureaucrats, politicians, Advocates, security officers etc were involved.

They cite numerous cases where the state police and role of Crime Branch had come under the scanner prompting the judiciary to intervene and handover the case to the central investigation agency.

PDP and National Conference had ordered CBI probes in the past

Even the ruling People’s Democratic Party (PDP) and Opposition National Conference, which have been opposing, tooth and nail, the CBI probe demand into Rasana rape, had been in forefront in raising such a demand for many cases in Kashmir or themselves handing over the cases to the CBI when they were in power.

In 2009 when twin rape and murder case of two Shopain young girls hit the headlines entire PDP leadership had pressurized Omar Abdullah led alliance govt to order CBI probe in the matter after initial investigations were allegedly botched up. Reluctant Omar Abdullah was left with no other option but to hand over the case to CBI.

At that time PDP leadership had refused to trust the police investigations but now as a ruling party, it was adamant on Crime Branch probe into Rasana rape and was refusing to hand over the case to the CBI.

Similarly, in 2006 when PDP-Congress were running the coalition and National Conference was in Opposition, the NC had forcefully demanded handing over of Kashmir sex scandal to the CBI.

The PDP-Congress Government had handed over the case to the CBI in which bigwigs like a top bureaucrat, politicians, Advocates, security officers etc were involved.
