“Why Shouldn’t We Act?”: Food Regulator Questions Protein Product Claims

India’s food regulator, the Food Safety and Standards Authority of India (FSSAI), said on Thursday that it has issued notices to Dr Reddy’s, Nestle Health Science, Tirupati Wellness, Amazon, Flipkart and Netmeds. The notices concern allegedly misleading health claims on products marketed for protein support and for maintaining lean muscle mass.

    What the regulator is questioning

In an Instagram post, FSSAI said it has asked the companies to explain why regulatory action should not be started against them. The claims in question relate to high protein content, lean muscle maintenance, muscle strength, immunity support and energy metabolism. According to the regulator, they were shown on the packaging in a way that could lead consumers to misunderstand the product’s health benefits. The notices also ask the companies to explain what the claims actually were and how they were presented to buyers.

    Next steps

The companies will have to respond to the regulator’s concerns before any further action is considered.

Other action announced the same day

FSSAI also announced action against Nex International and Shreyash Retail Pvt Ltd. These were for the sale of unsafe food and of expired or rotten food products, respectively. The regulator said it remains committed to safe and wholesome food, consumer protection and strict action against violations.

    Growing scrutiny of food claims

The move comes as FSSAI looks more closely at how food products market and label their health and nutrition benefits. It has stressed that such claims must be accurate and should not create a false impression of what consumers can expect.
