Speculation is put to rest as the apex court published the details

Bringing transparency, the Supreme Court Collegium on Monday published a Resolution, saying Justices D Y Chandrachud and S Abdul Nazeer objected to the letter of circulation by Chief Justice U U Lalit in the selection of four new Judges. “The proposal received the approval of Hon’ble Mr. Justice Sanjay Kishan Kaul and Hon’ble Mr. Justice K M Joseph vide their respective letters dated 01-10-2022 and 07-10-2022. By separate letters dated 01-10-2022, Hon’ble Dr. Justice D Y Chandrachud and Hon’ble Mr. Justice S Abdul Nazeer, objected inter alia to the method adopted in the letter dated 30.09.2022,” said the Resolution published in the Supreme Court’s portal.

“Thus, the proposal initiated by the CJI had concurrence from Hon’ble Mr. Justice Sanjay Kishan Kaul and Hon’ble Mr. Justice K M Joseph. Hon’ble Dr. Justice D Y Chandrachud and Hon’ble Mr. Justice S Abdul Nazeer objected to the process of selecting and appointing judges by circulation. The matter was, therefore, ideally suited to have a discussion across the table amongst the Judges forming the Collegium,” said the Resolution.

Though many in legal circles were sure that Justice Chandrachud objected to the Chief Justice’s method of circulation of letters instead of the physical meeting of the Collegium, the name of the second Judge was uncertain. Many speculated that the second Judge was Justice Sanjay Kishan Kaul[1]. Now the speculation is put to rest as the apex court published the details.

As Judges in the Collegium were out of Delhi due to the Dussehra holidays, CJI Lalit through a letter sent to fellow Judges suggested new four judges for appointment in the apex court on October 1. High Court Chief Justices Ravi Shankar Jha (Punjab and Haryana HC), Sanjay Karol (Patna HC), P Sanjay Kumar (Manipur HC), and senior Advocate K V Viswanathan were suggested for appointment as new Judges in the apex court. Collegium meetings are held physically and the meeting fixed on September 30 did not take place as Justice D Y Chandrachud’s headed Bench held the proceedings till 9:30 pm.

The Resolution said that the appointment of new Judges is stopped under the new circumstance. “In the meantime, a letter dated October 7, 2022, has been received from the Hon’ble Union Law Minister requesting the CJI to nominate his successor to take over the office of CJI w.e.f. November 9, 2022. In the circumstances, no further steps need to be taken and the unfinished work in the meeting called for September 30, 2022, is closed without there being any further deliberation. The meeting dated September 30, 2022, stands discharged”.
