
The doctrine of “sovereignty of Dharma” meets India’s Constitution: Art 363 dispute explained
We write this article after a thorough analysis of the 18th Oct 2025 document presented to Her Excellency Smt Droupadi Murmu ji seeking Art 143 reference to correct the Sabarimala judgment, along with all supporting documents relating to Art 363 Constitutional Rama Rajya dispute raised by Shri Chilkur Balaji Deity and letters of support for the same.
Vilasa Inscription, made post eclipse of Kakatiya Kingdom in the 13th century, details how many Kingdoms of the north, including Kakatiya Kingdom, which followed the principle of Rama Rajya in matters of substantial Deity interest (Sovereignty of Dharma governs substantial Deity interest), perished due to the missionary goal of invasion and its impact on Deity interest. Subsequently Vijayanagara Kingdom was born, and to a large extent, the damage to the Deity’s interest was rectified in the South. Vijayanagara Kingdom, which was born on 18th April, perished on 26th Jan due to the Tallikota war and led to the sacking of Hampi. It is the belief of devotees that the Republic of Bharat, which was born on 26th Jan, is the thousand-year stable Kingdom promised to Acharya Vidyaranya by the Devi at the time of birth of the Vijayanagara Kingdom, and the purpose of this article is also to explain this as an outcome of the dispute raised by Shri Chilkur Balaji Deity.
It is the belief of devotees that Shri Chilkur Balaji Deity’s pious purpose of incarnation and puja is to reestablish that sovereignty of Dharma governs substantial Deity interest in the entire unpartitioned sacred land of Shri Rama of Dharma, and for which a Waqf deed, which incorporates the grant from the patronage of the temple by Tana Shah, is also secured. Swami Vivekananda had recorded how the ancestors, following the footsteps of Jatayu and muslim rulers like Tana Shah, who had the great fortune of Shri Rama darshan and took on the entire might of Aurangzeb to protect Deity interest, sacrificed their lives.
“You have withstood the shocks of centuries simply because you took great care of it, you sacrificed everything else for it. Your forefathers underwent everything boldly, even death itself, but preserved their religion. Temple after temple was broken down by the foreign conqueror, but no sooner had the wave passed than the spire of the temple rose again. Some of these old temples of Southern India and those like Somnâth of Gujarat will teach you volumes of wisdom, will give you a keener insight into the history of the race than any amount of books. Mark how these temples bear the marks of a hundred attacks and a hundred regenerations, continually destroyed and continually springing up out of the ruins, rejuvenated and strong as ever! That is the national mind, that is the national life-current. Follow it and it leads to glory. Give it up and you die; death will be the only result, annihilation the only effect, the moment you step beyond that life-current,” Swami Vivekananda said.
We now look at another Kingdom down South, not touched by invasions except for a brief period when the invasion by Tipu Sultan was repulsed.
The Travancore Kingdom was miraculously not impacted by the Islamic invasions with goal to eradicate Deity worship and was dedicated to Shri Padmanabha Swamy Deity in 1750 by the then King Marthanda varma and the dedication which reads “from today I and those associated with me who are my relatives or who belong to my State and all that is material in the State are now consecrated to Shri Padmanabha Swamy…until Chandra and Surya exist, “Dharmaasmatkuladaivatam” i.e Dharma alone will be our Kuladeva…For this State, King is Shri Padmanabha, and we are only your representatives, and that too as Daasa, and would administer the State.”
The 1828 Missionary Gazetteer recorded how the concept of Sovereignty of Dharma governing substantial Deity interest in a Deity-ruled kingdom also gave rights to other religious denominations
“Travancore…is inhabited by various religious denominations; Christians, Jews, Mahomedans and Hindoos, worship according to their different creeds, without molestation from each other; and churches, synagogues, mosques, and pagodas, are intermingled. Impediments to the progress of Christianity, it is thought, may be expected from political rather than from religious jealousy” 1828 Missionary Gazetteer.
It is a matter of historical record that 100 years down the road the right given to religious denominations was (mis)used by the missionaries to work towards their goal of eradication of Deity worship and when Travancore Interim Constitution was framed while other subjects were given to legislature to make laws the subject of Substantial Deity interest was retained with the Ruler Deity represented by the Maharaja Shri Padmanabha Dasa. A letter sent in the 1930s by the then Dewan explains the risk of providing a Representative form of government and its impact on the Deity’s interest and provides the context for such safeguards in the Constitution. On November 12th, 1936 historic Temple Entry Proclamation was given, and the community of SC/ STs, who are known as Tiruppan Alwar Community, were given Temple Entry in over 1000 temples and followed by all, as it was felt to be the command of the Ruler Deity. Both Gandhi ji and Rajaji have recorded this as a miracle, and Rajaji, who had a key role in wording of Art 25 of our Constitution, has officially recorded the role of Shri Padmanabha Swamy Ruler Deity in this great reform, showing the way for the rest of the country.
When the Covenant and Instrument of Accession were signed by the Maharaja on behalf of the Deity and accepted by Rajaji on 15th Aug 1949 as the then Governor General, even though the power to legislate in matters of substantial Deity interest was given to the Legislature, the Right to enforce the limit of Sovereignty of Dharma was retained by the Ruler Deity. The White paper also records how the pious purpose of Art 8 of the covenant was to elevate the status of the downtrodden community, who were earlier provided Temple Entry to also secure a place in the Devaswom Boards. It is the belief of devotees that the White Paper fell somewhat short on the level of the elevation which was like Munivahana (in which we can see Temple Entry of Tiruppan Alwar belonging to SC/ ST community following command of the Deity and subsequently elevation above Archaka through Moksha granted by Shri Ranganatha Swamy Deity of Srirangam 2700 years back demonstrating that ultimately devotion is what matters).
January 22 1947 Objectives Resolution Rama Rajya principles (Dharma, righteousness is king of kings Dharmam Kshatrasya kshatram) pledge read with July 22nd 1947 government assurance (the right to worship in their own way and the protection of their language and culture) which is accepted to be the implied legal limit to constituent power of law making under Sec 8 of Indian Independence Act enacted with consent of 26 Lords Spiritual was enforceable by Ruler Deity and on His behalf by the Tiruppan Alwar Community in the previous constitutional regime right from 15th Aug 1949.
It is also a matter of record that the above limit was not respected by the people of Pakistan after securing partition without population exchange and the pledge (reminded by Lord Mountbatten to Pakistan Constituent Assembly on 14th Aug 1947) was broken and it has impacted Deity interest in Pakistan and now in Bangladesh and there is every chance that this approach of partition using path of Constitutional Democracy will again be attempted in future. It is also a matter of civilizational experience that fanatic followers of both Religious denominations, Christianity and Islam, who have many differences, come together on the shared goal of the eradication of Deity worship and partition is one great example. Even today, the World at large, which has many Christian and Islamic Republics, does not much care for the genocide of Hindus towards achieving the shared goal.
It is in the above context that we now see Art 363 Constitutional Rama Rajya dispute raised by Shri Chilkur Balaji Deity post Sabarimala judgment the letter of support on behalf of Tiruppan Alwar Community dated 26th Feb 2021 and draft notification sent on 26th April 2021 Rathatsavam day through this the birth of Tiruppan Alwar Ammal Doctrine of Dharma in the form of modified divine operative part in the draft notification on Jan 22nd 2024 the day of Shri Ram lalla pranaprathishta at Ayodhya. The community is gaining Munivahana (2700-year-old event recreated by Archaka recently) type elevation in the status to Ammal Status with the duty to protect Deity interest like a Mother protects her child, fulfilling the pious purpose of the covenant and instrument of accession. We can now thus summarize as below:-
Shri Chilkur Balaji Deity whose pious purpose of incarnation and puja is to reestablish that Sovereignty of Dharma governs substantial Deity interest in entire unpartitioned land of Shri Rama of Dharma for which a Waqf deed is also secured raised Art 363 Constitutional Rama Rajya dispute and established that this is legal limit to constituent power of law making in Sec 8 of Indian Independence Act enacted with consent of 26 Lords Spiritual and enforceable by devotional Tiruppan Alwar Ammal (SC/ ST) Community under Art 26 consented to by GOD of all Art 26 Religious denominations and other living beings whose ancestors like Jatayu and Tana Shah sacrificed to protect Dharma
Thus what was an implied limit i.e January 22 1947 Objectives Resolution Rama Rajya principles (Dharma, righteousness is king of kings Dharmam Kshatrasya kshatram) pledge read with July 22nd 1947 Government assurance (the right to worship in their own way and the protection of their language and culture) under Sec 8 of Indian Independence Act is now enforceable by Community on behalf of Deities in Art 26 read with Art 363 of Constitution of Bharat and the remarkable thing is that this is established under Art 60 Constitutional Oath in the name of GOD with consent of GOD of all Art 26 Religious denominations and for this one has to only read Dr Ambedkar explanation for why GOD is present in Constitutional Oath in the Constituent Assembly on 27th December 1948.
Thus it is established that while Art 26 provides Rights to all Religious Denominations including those of foreign origin whose followers around the world have missionary goal of eradicating Deity worship in Bharat responsible for breaking down of many temples and also partition; the same Art 26 also includes the Right of Deities exercised through devotional Tiruppan Alwar Ammal (SC/ ST) community to enforce the limit of Sovereignty of Dharma and protect Deity worship from being eradicated in this ancient sacred unpartitioned land of Shri Rama of Dharma. Also, like how Ayodhya temple was reclaimed in the future, Deity worship will be re-established even in partitioned lands, and the limit enforced this is the message of Jan 22nd 2024 pranaprathishta of Shri Ram lalla, other than the constitutional reason for making the limit enforceable in the legal personality of Shri Rama lalla using Ayodhya judgment reason for granting legal personality to Deity. There are several letters of support linking Art 363 Constitutional Rama Rajya dispute with Shri Rama Temple at Ayodhya, and most important is the letter of His Holiness Saantananda Maharshi Swamiji, who had made many Rama Rajya Ratha Yatras from Ayodhya to Kanyakumari and back, which records the wish of Jatayu expressed as part ancient Kingdom of Jetprole letter, and also letter of Vijayanagara Kingdom. Subsequently, the letter on behalf of the Gadwal Kingdom refers to all of the above while recording the reason why Hyderabad State did not merge and become like Pakistan, but merged with Bharat, which we now understand as part of the pious purpose of the incarnation of Shri Chilkur Balaji Deity of Telangana.
Once everyone irrespective of which Art 26 Religious denomination he or she belongs who takes Constitutional Oath in the name of GOD understands that in matters of substantial Deity interest it requires obedience to Tiruppan Alwar Ammal Doctrine of Dharma (Constitution and law it governs shall protect Deity interest similar manner mother protects her child) consented to by GOD of all Art 26 Religious denominations and other living beings whose ancestors like Jatayu and Tana Shah sacrificed to protect Dharma; Once the above pious purpose of Art 26 insertion by Kanchi Paramacharya and worded by Dr Ambedkar belonging to devotional Tiruppan Alwar Ammal (SC/ST) community revealed on the auspicious pranaprathishta day of Shri Ram lalla at Ayodhya is understood and followed and devotional contribution of Tiruppan Alwar Ammal (SC/ ST) community recognized then Bharat will have exponential rise as explained in the 26th January 2024 note and it will be the thousand years stable Republic promised after demise of Vijayanagara Kingdom.
