‘The Kashmir Files’ maker’s official statement that was to be read out in the Court

On Tuesday, the Bombay High Court has dismissed the plea seeking a stay on the release of the upcoming film “The Kashmir Files”. The PIL filed by Uttar Pradesh resident Intezar Hussain Sayed had sought a stay on the release of the film.

Produced and Directed by the National award Winner Vivek Agnihotri, The Kashmir Files is based on the Genocide and Exodus of Kashmiri Hindus and is inspired by true events.
Responding to the Court’s orders, Agnihotri tweeted, “This was my official statement given to advocates to be read out to the court. However, the need didn’t arise. #TheKashmirFiles #RightToJustice”

He said, “In the late 80’s and 90’s there was an organized Genocide of Hindus in Kashmir valley. This film is about the Genocide of Hindus, specifically about the inhuman and barbarian killings and rapes of innocent Kashmiri Hindus based on radical regional terrorism. The entire culture and diversity were destroyed. I believe there can never be any ‘other side’ of religious terrorism. I have presented all points of view, even that of the hardened terrorist and separatists, and leave it for the audience to decide which ideology do they want to stand for. I shall not make any changes in my film and I am willing to face consequences.”

A Bench of Chief Justice Dipankar Datta and Justice MS Karnik dismissed the public interest litigation (PIL). The bench said that the detailed order recording reasons will be given later. At the start of the hearing of the plea, the bench asked the lawyer representing the petitioner if he had bothered to read the judgment passed by them two weeks ago in PILs against the film Gangubai Kathiawadi. The bench had junked the petitions stating that the petitioners had not challenged the certificate issued to the film by the Central Board of Film Certification (CBFC).

The plea stated that the trailer of the film seemed to depict that the movie was about Muslims killing the Kashmiri Hindus, thereby hurting the sentiments of the Muslim community.

The plea also claimed that with elections being held in various states, there is the scope of misuse of the incident by political parties which could escalate to full-blown communal violence. Till the hearing of this plea, the petitioner prayed that the trailer of the film be taken down immediately.

The film stars Anupam Kher, Mithun Chakraborty, Puneet Issar, Pallavi Joshi, Chimnay Mandlik, and Mrunal Kulkarni. The film’s trailer and motion pictures released earlier have already been received very positively by the people. The film is set to release on 11 March.
