A BJP leader had asked police to examine whether a foreign citizen can join such agitations

Mumbai Police have served a notice on Bollywood actor Imran Khan, directing him to leave India by October 28. Officials said on Thursday that the action follows his appearance at a protest in the city, and that he is alleged to have violated provisions of the Immigration and Foreigners Act.

    The notice

Police said Khan holds foreign citizenship and is not an Indian national. A formal “Leave India Notice” has been served on him, and he has received a copy. The Foreigners Regional Registration Office (FRRO) in Mumbai has reportedly directed him to leave, and the actor is an American citizen who holds an Overseas Citizen of India (OCI) card. He is the nephew of actor Aamir Khan.

    What led to it

On October 10, Khan took part in an agitation at Mumbai’s August Kranti Maidan, where protesters demanded the resignation of Chief Election Commissioner Gyanesh Kumar. The demonstration was held in support of the Cockroach Janta Party (CJP). Police briefly detained him at the site, along with his girlfriend, Lekha Washington, and another person, Zayn Marie.

After being detained, he shared a photo from inside the police van on Instagram, with a light-hearted caption saying he was going for a drive.

    BJP leader’s complaint

Former BJP MP Kirit Somaiya had pushed for action. He urged Mumbai Police to act against the actor for joining a protest as a “foreign citizen” and asked whether Khan was legally allowed to take part in such agitations. Somaiya wrote to the Joint Commissioner of Police, Manoj Kumar Sharma, and said he had complained to immigration authorities, the Airport Authority and the police. He also asked Maharashtra Chief Minister Devendra Fadnavis to step in.

    What happens next

The reports do not say how Khan or his team will respond to the notice, and police have not detailed which specific provisions of the law he is accused of breaching.
