Krishna Janmabhoomi case: Massive relief for Hindu side as HC dismisses Muslim side’s plea on maintainability

The Allahabad High Court has rejected a petition filed by the Muslim side challenging the legitimacy of lawsuits brought by Hindus in the Shahi Idgah Mosque-Krishna Janmabhoomi dispute in Mathura. Justice Mayank Kumar Jain delivered the verdict, concluding proceedings that had been under review since June 6, 2024.

Justice Mayank Kumar Jain‘s bench is overseeing 18 suits related to the dispute, 15 of which have been consolidated for joint hearings. The Muslim party had invoked Order 7 Rule 11 of the Civil Procedure Code (CPC) to contest the admissibility of the lawsuits. These legal actions assert Hindu claims over 13.37 acres of land in Mathura, which include the area occupied by the Shahi Idgah Mosque.

The High Court extensively heard arguments from both sides over multiple hearings. The judgment, initially reserved on May 31, was reopened to allow Adv Pracha one more opportunity to address the court before being reserved again in June.

Ultimately, the High Court rejected the Muslim side’s plea, affirming the maintainability of the Hindu suits, thus paving the way for further legal proceedings on the substantive issues of the case.
