
Case transferred from Rae Bareli to Lucknow
The Lucknow High Court on Friday directed the registration of an FIR and ordered a probe into allegations related to the citizenship of Congress MP Rahul Gandhi.
The order came from a single bench while hearing a petition filed by complainant Vignesh Shishir, who had challenged a January 28 decision of a special MP/MLA court in Lucknow that had rejected his plea seeking an FIR against the Congress leader.
Court calls for examination of claims
During the proceedings, the High Court observed that the allegations made against Rahul Gandhi warranted examination and directed the state government to take appropriate steps to investigate the matter.
The lower court had earlier ruled that it did not have the jurisdiction to decide issues related to citizenship.
Petitioner cites documents and emails
The petitioner has claimed that he possesses documents, including alleged emails from the British government, which he says indicate that Rahul Gandhi holds British citizenship.
According to the plea, if proven, this would make Gandhi ineligible to contest elections in India or hold the position of a member of the Lok Sabha.
The complaint includes allegations under provisions of the Bharatiya Nyaya Sanhita (BNS), as well as the Official Secrets Act, the Foreigners Act, and the Passport Act.
Case background
The complaint was initially filed before a special MP/MLA court in Rae Bareli on December 17, 2025, before being transferred to Lucknow by the High Court.
After the Lucknow court dismissed the plea seeking registration of an FIR, the petitioner approached the High Court, leading to the latest order.
