It was literally chaotic. During the beginning of arguments in the Ayodhya case, a battery of lawyers, led by Congress leader Kapil Sibal in the Supreme Court, tried to bully the apex court. This exposes the fact that the Congress leadership, Sunni Muslim, Left – Liberal and the so-called secular leaders are delaying a permanent settlement to the Centuries-long dispute.
At last Sibal tried to provoke BJP leader Subramanian Swamy, the intervenor in the case by alleging that Swamy is behind the speedy listing of the case. Sibal produced Swamy’s widely published letter to Prime Minister Narendra Modi urging for the speedy disposal of the Ayodhya case by giving directions to government law officers.
Kapil Sibal and the main lawyers Rajeev Dhavan and Dushyant Dave all tried their best to stall the arguments in the beginning itself by telling a blatant lie in the court that the documents were not supplied. But it was exposed by the Additional Solicitor General (ASG) Tushar Mehta, representing the Uttar Pradesh Government and Harish Salve representing Hindu Mahants by pointing out that all documents from their part were received by the Sibal’s side.
Then Sibal, representing the Sunni Wakf Board, Dave and agent provocateur Dhavan, who often uses abusive words inside and outside the courts, started bullying the Bench led by Chief Justice (CJI) Dipak Misra, comprising Justices Ashok Bhushan and S Abdul Nazeer. First, they said that this case should be heard by a larger Bench, then they said the case would be held only by July 2019 and at last, they staged a drama by declaring that they need permission to boycott the court!
A high voltage drama ensued, with lawyers representing the Sunni Waqf Board and the Babri Masjid Action Committee, virtually threatening to walk out of the proceedings as the bench asked senior advocate C S Vaidyanathan, representing the deity Ram Lala Virajman, to commence his submissions in the case. When the bench headed by the CJI rejected their contention that the matter be sent to a larger bench saying “no, no…”, Sibal, appearing for Sunni Wakf Board, said, “I do believe that any decision, in this case, will have very serious ramifications and the appeals should be referred to a five or seven-judge constitution bench. Do not say ‘no, no, no’. Please hear the matter keeping in mind the ramifications…”
He further said, “please fix the matter in July 2019 and we assure that we will not seek any adjournments… Justice should not only be done, it should seem to be done.”
The bench countered expressing shock and surprise and asked, “What kind of submission is this? You are saying July 2019. Should it not be heard before that?”
Another senior advocate Dushyant Dave, appearing for one of the parties, questioned the “hurry” in hearing the appeals and referred to the fact that the issue of Ram Temple was part of the BJP manifesto. To this, the bench retorted: “You say it should not be heard ever only because it was not heard in last seven years.”
At last Sibal tried to provoke BJP leader Subramanian Swamy, the intervenor in the case by alleging that Swamy is behind the speedy listing of the case. He read out Swamy’s letter. But Swamy kept quiet, smiling witnessing Sibal reading his letter to Modi. Keeping decorum inside the Court, Swamy started attacking Sibal and Congress in the media after the hearing.
Sibal’s move has created a huge embarrassment for Congress. Sibal had created another flutter after his infamous Zero Loss Theory for the party. Can the Congress party risk its future in the 2019 elections and beyond, if its prominent leader Sibal continues this line of questioning?
The agenda of the anti-Ram Mandir brigade is very clear. They want to scuttle the hearing. If hearing starts, they knew the Judgment will come before October 2018, before the retirement of Chief Justice Dipak Misra. Come February, will they adopt the same strategy and pay a big political price?
