Delhi court allows Dr. Swamy to file reply opposing Rahul Gandhi’s plea for passport

BJP leader Subramanian Swamy on Wednesday opposed the petition filed by Congress leader Rahul Gandhi before a Delhi Court seeking the issuance of a fresh passport. Rahul applied for an ordinary passport after he surrendered his diplomatic passport when he was disqualified as MP after he was convicted for two years in a defamation case.

Appearing before Additional Chief Metropolitan Magistrate Vaibhav Mehta, Subramanian Swamy objected to issuing a new passport to Rahul Gandhi, saying that if Rahul is allowed to travel abroad, it may hamper the probe in the National Herald case. The court called Swamy after Rahul Gandhi filed the petition seeking no objection to getting an ordinary passport. Earlier day Rahul’s counsel said that there are no criminal cases pending against him and therefore, he can be granted a no-objection certificate. However, the Court opined that Swamy has the right to file a reply to Gandhi’s plea.

The case is listed for further hearing on May 26 and the court has asked Subramanian Swamy to file a written submission. Swamy is a petitioner in the National Herald case and the accused persons Sonia Gandhi, Rahul Gandhi, and other directors Motilal Vora, Oscar Fernandes, Suman Dubey, and Sam Pitroda are out on bail now. The Enforcement Directorate is also probing the money laundering angle in the National Herald case.

Rahul Gandhi was disqualified as an MP after being convicted of criminal defamation for on March 23 for his remark “All thieves have Modi surname” which he had made at an election rally in Karnataka’s Kolar in 2019. In his speech, Gandhi linked Prime Minister Narendra Modi with fugitives like Nirav Modi and Lalit Modi. Rahul was convicted for two years by a Surat Court and an appeal is pending before Gujarat High Court.

Meanwhile, Union Home Ministry in April 2019 issued a notice to Rahul Gandhi for holding a British passport illegally on Subramanian Swamy’s complaint. Swamy in his complaint to Home Ministry and other agencies produced documents of a British company, where Rahul is a Director declaring himself as a British citizen with a London residential address[1]. Many times Swamy petitioned against Rahul Gandhi for multiple passports in India, British, and Italy and for holding several foreign bank accounts. Advocates Tarannum Cheema, Nikhil Bhalla, and Sumit Kumar appeared for Rahul Gandhi. Subramanian Swamy was assisted by advocates Satya Sabharwal and Vishesh Kanodia.

After coming out from Court, Subramanian Swamy spoke to the media, about why he objected to Rahul Gandhi’s application for a fresh passport. Swamy said that Court should get the opinion of the Union Home Ministry on Rahul Gandhi’s British citizenship issue.
