Dr. Swamy to provide assistance in pending case on cleanliness of river Yamuna

The Supreme Court on Friday asked BJP leader, Dr. Subramanian Swamy, to intervene in a suo moto petition on remediation of polluted rivers instead of pursuing his Public Interest Litigation (PIL) on the cleanliness of river Yamuna. A bench of Justices D Y Chandrachud and Surya Kant told Swamy, who has moved a PIL seeking to construct a parallel channel/ canal alongside the river Yamuna in Delhi, which would collect the sewage and untreated water and divert it, that there is already a suo moto petition pending before the court.

Justice Chandrachud told Swamy it would be appropriate if he files an intervention application in the said petition instead of pursuing a fresh petition. “We have issued a notice in the suo moto petition. We are seized of the matter. You can intervene in that matter. In fact, we would like to have your assistance in that matter” said Justice Chandrachud.

Swamy agreed to the suggestion and urged the court to pass a direction in this regard. The bench then passed the order and asked Swamy to keep track of a matter related to cleaning or river Yamuna which is pending before the National Green Tribunal. Advocates Mayank Mittal and Udit Saxena co-petitioners of Dr. Subramanian Swamy gave many suggestions to cleanse and control the pollution in river Yamuna.

In his petition, Swamy suggested the construction of a parallel channel/ canal alongside the river Yamuna in Delhi, which collects almost all the sewage (treated or untreated) and diverts the same, similar to Thames River London. The petition also suggested, “to develop a greenbelt/ greenway on both sides of the embankment of river Yamuna” to control erosion, reduce sediment and enhance the beautification for attracting tourism.

Subramanian Swamy pointed out that the river Yamuna accounts for over 70% of the total water supply for the people of Delhi. … ”wherein besides being the main source of drinking water, such water is used for both abstractive and in stream uses like irrigation, domestic water supply, industrial, etc,” pointing out the petition, narrating the huge pollution in river Yamuna, mainly happening from Delhi side.
